New Delhi, Dec 14 (PTI) The Supreme Court today told cellular operators that it might ask BSNL to provide them new Points of Interconnection (PoI) at Rs 39,000 per port, if they undertake to pay the differential amount to the telecom PSU if their plea for lower charges fails.
A bench of Chief Justice S H Kapadia said it would pass directions on their plea only when, they agree to give an undertaking in this regard along with a bank guarantee.
"Would you give an undertaking that the differential amount between Rs 39,000 and Rs 55,000 would be paid by you (along with the interest) if you loose the case.... question is that," asked the bench which included justices K S Radhakrishnan and Swatanter Kumar.
"You would have to give bank guarantee of a nationalised bank and an undertaking by any managing director or any higher authority ... you can not escape from it," the bench said.
On this senior advocate C S Vaidyanathan, appearing for Cellular Operators Association of India (COAI), said that he would respond tomorrow after consulting the stakeholders.
