Option forms

BSNLEU has signed the new promotion policy for non executives. FNTO wrote the BSNL management seeking some clarifications regarding giving options. BSNLEU who signed the agreement before verification has written a letter seeking clarifications.  We hope BSNL management will issue clarifications shortly.
Meanwhile it has been reported that some SSAs are fixing dates for giving option forms.  As per the policy, 30 days time is given for exercising option from the date the local administration circulates this new policy. This time factor was also taken up by FNTO with the BSNL  management. If any difficulty is experienced in giving options,T.N.Circledistrict secretaries are requested to contact the GM of the respective SSAs in writing regarding time factor for giving options. Or contact the Tamil Nadu  Circle Secretary  for  further instructions.

Bank employees in 26 public and 12 private sector institutions will see their salaries increase by 17.5 per cent, with the Indian Banks’ Association (IBA) and bank unions on Tuesday signing an agreement on pay revision.

The agreement also gives an opportunity to those who had not opted for the pension scheme in 1995 to join the scheme again. “We have signed an agreement today with banks’ unions and according to the new agreement, employees and officers will get a 17.5 per cent hike in salaries with retrospective effect from November 1, 2007,” IBA Deputy Chief Executive K Unnikrishnan told the news agency.

Almost eight lakh employees in 26 public sector banks, 12 private sector banks and eight foreign banks will be benefited from this new wage agreement, he said.

In all, there are over 10 lakh people working in the country’s 26 public sector banks and 23 private sector banks in the country, besides 31 foreign banks.

The revision will cost banks Rs 4,816 crore, including arrears payment from November 2007 which will be given in one-go, he said. There is good news also for employees who did not opt for the pension scheme in 1995, he said.

“The new agreement gives an opportunity to those who had not opted for the pension scheme in 1995, but contributed to Provident

Fund (PF), to join the scheme again. Those who are interested can contribute to the arrears directly to the pension fund with an amount to bridge the gap in the fund. Those who already retired from the service can also join the scheme, he said.

A call for a change.

Right now, that is a problem the Telecom Ministry, and indeed the GoM, will have to come to grips with at some time or the other, simply because the fate of the erstwhile leader of the telecom pack hangs in the balance. Last year, BSNL, with the first-mover advantage, suffered a loss of Rs 3,641 crore that the firm says was on account of wage arrears of around the same amount; but everyone knows the slide had begun much before, with 2008-09 profits falling some 80 per cent.

More than in any other industry, telecom firms need to be nimble and adept at productivity upgrade and adapting to global trends and needs. At the same time, changing the structure of the state-owned firm requires a mix of firm resolve and empathy-talking to employee unions. That process should have started before the Pitroda panel raised hackles; even so, it is never too late.

 We are looking at disinvestment of seven to eight companies this year. It would not be possible to work on more public issues in one year. The market should also be ready to accept the issues,” said an official in the finance ministry, who did not wish to be identified.
A significant part of the disinvestment target would be met through stake sales in companies such as Coal India Ltd (CIL) and Steel Authority of India Ltd (SAIL), he added.
Other big issues could come from Bharat Sanchar Nigam Ltd (BSNL) and MMTC, while Hindustan Copper, Manganese Ore India Ltd (MOIL), SJVNL and Engineers India Ltd (EIL) would be smaller issues.
The fate of some of the big issues, however, hangs in balance. The disinvestment department is struggling to find the right valuation for trading company MMTC and this could take the company off the disinvestment list this year. BSNL and CIL are facing opposition from trade unions.

New Delhi, Apr 25 (PTI) The Department of Telecom has started laying the groundwork for identifying real estate assets which would be transferred to BSNL to help the PSU form a land bank, in line with the Sam Pitroda panel's suggestions.


BSNL, which was carved out of the DoT in 2000 as a separate service unit and was corporatised, has huge land assets at its disposal, which the panel suggested should be converted into a land bank and monetised in future.


A DoT official said for developing land bank, the land first needs to be transferred to BSNL first.


A DoT internal note said an exercise is already going on for retention of certain assets by DoT for its field units and transferring the rest to BSNL by signing transfer agreements.


"It is proposed to complete signing of TA in time-bound manner within six months.End of the report.

The Open Session was held in grand gala manner on 23.04.2010 with attendance of more then 450 members. The hall was jam packed. S/Shri Shaktisinh Gohil, Leader Opposiion, Gujarat Vidhan Sabha, Satya Pal, CGM Gujarat, V.K. Sajnani, GM (A), Ashutosh Sharma GM Nadia, Thomas John K, All India President, K. Shri Vallinayagam gave details of discussion of JAC meeting dated 20.04.2010 with MOC & IT. He said that JAC was assured that Pensioner Revision on IDA scale will be done. MOC has assured his utmost cooperation. Mr. Vallinayagam requested the CGM to take note of the representations made by BDPA Gujarat on various pensioners’ related matter and cause early settlement. He said that in the days to come, all will have to join the Pensioners and share their concern.
 Mr. Thomas John had drawn the attention of the Management towards irregularities and harassments to members in transfer issues’.
Satya Pal said that BSNL Gujarat is not incurring any loss and revenue is on increase in April, 2010.
Mr. V.K.Sajani, GM (A) assured that the Management shall try to have transparency in transfer issues.
 Mr. Shaktisinh Golil, Opposition Leader Gujarat Vidhan Sabha gave history of Telecom since its inception and also added that he is taking all care to see that the BSNL gets justice. Since the BSNL is service oriented organization, loss incurred due to providing services in remote area should not be a matter of concern.

The Madras High Court has dismissed a writ petition from a Udhagamandalam-based company challenging the award of the Labour Court, Coimbatore, directing the management to reinstate a workman who was dismissed on July 4, 1997 on charges of misleading it in connection with his conviction by a criminal court for rash and negligent driving.
The management of Rallis India Ltd, Fine Chemicals Division, in the petition contended that a criminal case was registered against the worker (Leon Lenard), who was serving as a driver, for rash and negligent driving. He pleaded guilty before the Judicial Magistrate and was convicted. Subsequently, the management came to know that the worker was involved in an accident in which he had also paid fine in the case.

Promotion policy-BSNLEU says.

FNTO already informed through journals and by circulars that this is a truncated promotion policy. This needs several clarifications. FNTO recently wrote a letter also seeking clarficiations from the management.This is available in fnto union sites. Now BSNLEU has written to the BSNL Management seeking some clarifications.  But to our dismay, BSNLEU recently informed through their website instructing all the district secretaries to approach the management to implement the new promotion policy.
BSNLEU wants the policy to be implemented then.. Now there is a nose dive .Now they write to the management  to clarify things. What happened to BSNLEU?. Why sudden change of things?

According to the telecom ministry, it could take another two to three months for the home ministry to give its clearance, but are hopeful that India will see number portability well in place before the end of 2010.

MNP allows consumers to retain their mobile numbers when transferring from one mobile network to another. Since this unleashes genuine competitive pressures, its biggest upside is a marked improvement in quality of service. It could also marginally reduce tariffs in areas like international roaming and value-added services where there is insufficient price competition.

The department of telecommunications (DoT) has proposed that Bharat Sanchar Nigam Ltd (BSNL) should be taken out of the purview of the Public Enterprise Selection Board (PESB) in respect of selection and salaries of the board and higher level of management.

DoT wants to restructure the BSNL board with chairman from private sector. This is not possible as BSNL chairman and managing director (CMD) gets a salary less than Rs 20 lakh per annum. CEOs in the private telcos get salaries ranging between Rs 4 crore to Rs 6 crore per annum.

Sources said that the DoT will seek full telecom commission’s approval in a meeting to be held in the first week of May. Full telecom commission is the final decision making body in telecom and comprises secretaries of ministry of finance, industry and Planning Commission.

“This has never happened in India. It will require prime minister’s approval,” said a senior official in DoT.

BSNL is 100% owned by the government. In India, selection of the board and their financial emoluments are governed by the PESB.

Sam Pitroda committee had recommended appointment of an eminent person from private sector as chairman. He should have strategic vision and capability to interface with the external world.

Pitroda has also proposed separating the post of managing director/CEO and chairman. CEO should have experience form the relevant domain. Higher management would include COO, CFO, CIO and CTO. All of them would report to CEO.

The committee has also recommended that a three year contract should be signed with all the key members (30 – 40) and they should be given stock options.

It is not clear that who will be responsible for selection of chairman and CEO of the company.

State-run telecom major Bharat Sanchar Nigam Ltd could register a loss of Rs 3,641 crore in 2009-10 according to a document prepared the Parliamentary Standing Committee on IT.
BSNL has so far reported profits in the past years.
The Department of Telecom in a submission has said the reason for the loss is the potential incidence of payment of arrears amounting to Rs 3,600 crore to non-executive employees with effect from July 2007.
Major reasons
Another major reason for the potential loss is the income coming under pressure due to reducing tariffs in highly competitive market, sharp reduction in landline revenue, stoppages of licence fee revenue, among others.
The financial results of the company are yet to be announced. The Standing Committee has, however, not accepted the reasons like non-finalisation of orders, non-timely supply of equipment, reducing tariffs in highly competitive market, sharp reduction in landline revenue, stoppage of licence fee reimbursement, lower returns on investment.
The panel noted that private service providers are making profits despite operating in the same market.

BSNL too performed comparatively better with 2.4 million monthly additions and scaling past the 63.48 million subscriber base mark.

The South Goa Consumer Disputes Redressal Forum on Thursday heard arguments on the maintainability of telecom complaints in consumer courts in light of the Supreme Court's judgment ending jurisdiction of consumer courts to entertain disputes relating to telecom services.

After hearing the arguments of 15 lawyers representing nearly 27 cases on telecom services, the forum asked parties to submit clarifications with regard to a notification issued by the union telecommunication ministry on May 24, 1999.

NEW DELHI: The Telecom Commission, the policy-making wing of the DoT, will soon take up the issue of disinvestment in state-run BSNL, Telecom Minister A Raja said today.

"In a few days, the decision of BSNL board on the Sam Pitroda committee report and IPO is going to be discussed in the Telecom Commission," Raja said on the sidelines of an event.

Following the deliberations by the commission, the outcome will be placed before a Group of Ministers (GOM), which is yet to be constituted, he added.

Truncated promotions options.

Suggestion for excercising options
(From our CHQ)

1) If NO promotion or upgradation is received after 1-10-2000, it is better for them to opt for new scheme. In such cases, they will get I promotion on 1-10-2004 and second promotion on 1-10-2011.

2) If any employee got promotion after 1-10-2000 but before 1-10-2004 he can opt for new scheme in which case the above promotion will be treated as First promotion and the second promotion will be seven years after the date of First promotion. In that case he will have to refund the financial benefits availed from that promotion upto 31-3-2008 as the I promotion in the new scheme is notional upto 31-3-2008.

3) If any employee got the promotion after 1-10-2000 but from 1-10-2004 to the date of issue of orders on new promotion i.e., 23-3-2010 , such employees can opt for the new scheme. In this case he will be given I promotion from 1-10-2004 notionally with financial benefit from 1-4-2008. Next promotion i.e., II promotion will be from 1-10-2011. The promotion already given under OTBP/BCR/Grade IV/ACP will be treated as cancelled.

4)If any employee got a vertical promotion (such as RM to TM, TM to TTA/Sr.TOA eyc) after 1-10-2000 but before 1-10-2004 it will be treated as First promotion and second promotion will be given after 7 years from the date of I postbased (vertical) promotion. In this case he need not refund the financial benefit obtained due to to vertical promotion

5) If any employee got a vertical promotion after 1-10-2004, he will be eligible for I promotion in the previous cadre (held as on 1-10-2000) from 1-10-2004 and the vertical promotion given after 1-10-2004 will be treated as second promotion and the next promotion will be after eight years from the date of II promotion.

Indefinite Strike   called off:
       The strike called by the JAC of unions/associations in BSNL aws called of in the afternoon of today without any agreement signed by any trade unions. The decisions to call off the strike was taken by the JAC after it’s leaders held second round discussions with the MOC&IT Hon’ble A.Raja on 20/04/2010 at about 12.30Hrs. There was no change in the attitude of Minister/ Govt Of India with regard to the following 3 main demands.
1.    No disinvestment in BSNL- It was not agreed by the govt.
2.    No VRS scheme as per the Sam pitroda recommendations-This demand was also not agreed by the govt.
3.    No unbundling of BSNL cables & permitting the infrastructure sharing by Private operators- This demand  too was not agreed by the govt.
        However, It was reported that the Minister has agreed to speedy implementation of 2nd wage revisions to the employees and absorption   issue of ITS officers will be speeded up after 3 months.
       NFTE-BSNL thanks all comrades for participating in the historic strike. As per the report received from all over the country nearly 99% of our employees/ Executives have participated very enthusiastically in the strike. But we could not understand   the reasons for calling off such a massive strike action without settling any of the demands notified for the strike.

Mobile tariff go down.

NEW DELHI: Consumers can look forward to further slashing of mobile tariffs, especially SMS, with the Trai opting against any tariff regulation.

Last year, the offer of a pay-per-second plan by a new operator triggered off a price war, leading to charges of predatory pricing by some telecom operators. Around the same time, a TOI report of November 5 had exposed that SMS costs are a fraction of a paise while consumers are charged between 50 paise to Rs 1.50 to send SMSes. Both these developments invited the attention of the regulator.

Trai’s chairman J S Sarma responded by stating that the pay-per-second plans could be predatory and that Trai would seek cost data from operators and intervene if necessary. However, the attack that followed from consumer organizations, parliamentarians and media has led to the Trai backing off, at least, for now.

The minister told the employee unions on Tuesday that the proposed listing of BSNL will now be considered by a group of ministers (GoM). He also added that the Centre will first hold discussions with unions before taking a final call on the issue, two people present at the meeting said. The larger implication is that BSNL’s IPO is unlikely this fiscal as the employee unions are bitterly opposed to the proposal. The BSNL board had cleared this proposal in 2008, but strong opposition from the unions, which claim to represent 300,000 employees, has made sure that the plans remain only on paper. Mr Raja also assured the representatives of employee unions that the Centre would consult them before implementing the Sam Pitroda committee report, which recommended the telco’s three lakh staff be reduced by a third.

           As informed over phone strike by JCA in Kerala was total..No ITS Officer was permitted inside the offices in Kerala .At Trivandrum Chief General Manager Shri K S. Srinivasan tried to enter by pushing the Employees with a group of ITS Officers. He was not permitted. Then he returned with the Commissioner of Police and after an agreement with unions CGM alone was permitted to avoid large-scale arrests and entry of other ITS officers.

At Trichur PGM Dr Thomas Philip tried to enter breaking the cordon of Employees.He called the police and 11 BSNL Employees arrested including District Secretary Trichur of NUBSNLW (FNTO) Shri K.JAYAKUMAR, Francis, and Reghu from FNTO, 1 from BTEU (BSNL) and others from BSNLEU They were kept under police custody for more than 3 hours and were released after submitting bail.

In other SSAS s AT Cochin PGMT was permitted after 2 hours arguments. At CAlicut PGM remained outside. At CAnnanore all were kept out, In other SSA s like Pathanamthitta, Kottayam, Aleppey, Malappuram ITS officers were not permitted to enter.

All Officers/Staff owing allegiance to FNTO, BSNLEU, SNEA, AIBSNLEA ,BTEU BSNL participated in the strike with 100% support. Only a few of the direct recruited employees permitted, to enter office

Wage revision.

Because of our unity on 20 04 10 strike, Minister has agreed to settle wage revision for non executives within 15 days. It is indeed a major achievement for our unity. Many non executives openly commented that wage revision is not in the agenda.

The subject of wage revision is not included in the agenda but it came up for discussions and a categorical assurance was also got from the management. 
Hats off to all involved in the talks. 
Once again it is proved that unity will make lot of gains.

Call off strike?

In the discussions held by all unions with the Minister, it was agreed that 'JAC expressed satisfaction and agreed to call off the strike."
What does it mean?
It is meant that the striking workers can resume duty immediately. 


As per the directions of the unions. workers are ready to go on strike to achieve their demands and also to safeguard BSNL.When the Joint Action Committee at New Delhi  agrees satisfaction regarding the outcome of the talks and agreed to call off the strike,what prevents the workers to resume duty.  


The JAC at New Delhi says that the strike is called off , it simply means that workers can report to duty. 
At Nammakal, it was reported that 2 lakhs was collected by our staff after strike was called off. 
At Pondicherry , it was reported that workers were prevented from joining.
When the unions call for strike.workers respond positively by going on strike. When the CHQ directs that workers to resume duty, it is duty of the workers to report to duty. 
Through unity, we achieve many things. Simple issues should not hamper our unity.

Himalayan let down: Hours after the indefinite strike started, a drama has been enacted culminating in the JAC calling off the strike based on mere assurances from the Minister, which are nothing but empty assurances which are only repetition of what the Minister had said on Friday the 16th April 2010 to the JAC. The record of the discussions with the Minister shows that the JAC has made an abject surrender without a single demand being resolved and also putting a large question mark over the future of the BSNL employees and executives. On the main issue of opposing disinvestment, on which we had lent our support to the the strike, the record says that all stake holders will be taken into confidence before arriving at a final policy decision by the Government. But moments after the meeting with JAC the Minister has spoken to the press that this issue will be referred to Group of Ministers. This is a sample of the fate these assurances are going to face. On the issue of ITS absorption and Pension revision for pre 1.1.2007 pensioners, the JAC has agreed to preparation of cabinet note which is absolutely not necessary, since extant orders are enough to settle these issues. The ploy of cabinet note is the same old trick to indefinitely delay things. Thus the JAC has given further unending lease of life for ITS officers and put the pensioners into more trouble. Overall the strike settlement is nothing but a farce, which makes mockery of the unsuspecting and innocent employees, and has done irrepairable damage to the interests of the Executives and Employees of BSNL for a long time to come. Once again these leaders have let down the interests of BSNL and the interests of their own members, by willingly landing into the trap laid by vested interests in the Government and BSNL Management.

                  Immediate recuritment of DGMs
Hon'ble MOC was in detail apprised about the deliberate attempts being made to derail the process of absorption of ITS and how inordinate delay has adversely affected the growth of BSNL. After getting elaborate feedback from JAC, Secy/DOT apprised that Cabinet note being sent does not contain any demand of ITSA regarding their absorption, neither prospective date of absorption or any other new demand. The note only explains in detail that the absorption process initiated by DOT twice has not met with considerable success, and, as such, Cabinet is being approached to advise DOT as to how to go about in such a situation and deal with huge number of ITS officers having decided not to get absorbed in BSNL. For this, wider consultations with Ministry of law, DOP, D.O.E etc are needed which is expected to talk another three months. After getting advice from Cabinet, DOT will immediately act on the advice of the Cabinet. Hon'ble MOC is fully committed to get the issue conclusively resolved, and is now informed of all the dimensions of the issue. What is extremely significant is that Hon'ble MOC also directed BSNL Management to take immediate action by way of recruitment of DGMs and MTs so that a parallel middle level Management is available in the event of repatriation of ITS from BSNL. When we pointed out that the eligibility conditions for recruitment of DGMs and MTs are finalized in such a manner so as to derail the process, Hon'ble MOC  directed CMD and Director(HR) to discuss and finalize eligibility conditions afresh in consultation with the Associations. However, on ITS absorption, two important issues have surfaced, one is that Hon'ble MOC's committed involvement and non inclusion of demands of ITS in the Cabinet note, and the second one is taking immediate action in the direction of setting up a parallel middle level Management in BSNL.

Our comments: 20 04 10 strike  makes BSNL to go for immediate middle level management. So you all know  who gains out of this strike?

About 78.2% IDA merger

When the demand of fixation of new IDA scales @ 78.2% was strongly pleaded with Hon'ble MOC, he clearly directed CMD to discuss the issue with executive / non Executive Associations / Unions, failing which he advised us to meet him.

Our Comments: The issue of merger of 78.2% IDA merger with the pay scales of executives and non exeuctives  has to be done by the BSNL Management.
The issue of merger of 78.2% for non executives was all along advocated by FNTO.  Somedays back, DoT has also raised query why it has not been merged with the pay scales. 

It is learnt that the issue of 78.2% IDA merger which was not in the agenda of Joint Action Committee discussions cropped up before the Minister on 20 04 10 during discussions. 
Even at that time, BSNL management said there was no funds to merge 78.2% with the pay scales. The Minister immediately told the CMD,BSNL to look into this matter.If not, all unions can approach the Minister straightaway.
If it is merged with the pay , it is duly only  by virtue of unity among all unions.
Hope unity paves way for merger of 78.2% with the pay scales of executives and non executives.

Within hours of going on indefinite strike, the employee unions of BSNL on Tuesday called off the protest after the government assured that the issue of disinvestment in the telecom PSU will be referred to a Group of Ministers.
“We have assured them (unions) that the issue of disinvestment will be referred to a GoM and they would be consulted before taking other decisions with regard to BSNL,” Telecom Minister A. Raja said.

Telecom-panel- recast BSNL

MUMBAI: Telecom Commission (TC), the policy-making wing of the Department of Telecom, will meet on Tuesday to consider some key recommendations of the Sam Pitroda Committee regarding the restructuring of Bharat Sanchar Nigam (BSNL).

TC will only look into proposals related to the recasting of BSNL board, absorption of Indian Telecom Service (ITS) personnel, disinvestment and initial public offering and the creation of a subsidiary to hold the undeveloped land bank. Other recommendations, which pertain to business and operational matters, will be dealt with by BSNL itself, according to a DoT note.

BSNL JAC opposes committee recommendations
Staff Reporter VIJAYAWADA: The BSNL Officials and Employees' Joint Action Committee (JAC) has expressed strong reservations against the recommendations of the Sam Pitroda-headed three-member committee for reducing workforce in the telecommunications company besides suggesting introduction of outsourcing at various levels.
The JAC leaders dismissed as unscientific the recommendation of the Pitroda committee regarding the comparison of operations and services rendered by the BSNL and the private telecom companies in the process of recommending changes.
Addressing a press conference here on Sunday, JAC district chairman K. Dharmangadudu and convener K. Prasada Rao and others said they would organise protest programmes as part of the nation-wide calls given by their associations. An indefinite strike will be observed from April 20 for which they appealed to the employees to participate and make it a grand success. Earlier, a dharna was held at the telecom district office in the city on March 26 in support of their demands.
The JAC leaders demanded that the process of ITS officers being integrated into the BSNL should be completed without losing further time. They also sought the withdrawal of the proposal to give up the Government's stake of 30 per cent in the BSNL. Also, the move to remove one lakh employees of the BSNL in the name of VRS or transfers should be withdrawn. The efforts to introduce outsourcing should be stopped immediately.
The JAC district leaders said while the Pitroda committee was constituted to suggest measures for the protection of the BSNL, it made recommendations that would destabilise it and harm the interests of lakhs of its employees. They asserted that the BSNL had got the credit to have provided telecom services in the every nook and corner of the country at affordable prices. It was the BSNL which got the 80 per cent market in the landline services across the country.
The JAC leaders deplored that it was because of the harmful policies of the Government.

BSNL staff on strike from Tuesday; telecom services may be hit
Telecom services, especially calls to and from BSNL network, will be disrupted from Tuesday morning, with nearly 3 lakh employees of the PSU beginning an indefinite strike to protest VRS and divestment proposals of the Sam Pitroda committee .

"We have not heard of any concrete decision from the management or from the government. We are beginning strike from six in the morning from tomorrow," Chandeshwar Singh, General Secretary, National Federation of Telecom Employees, said.


"I had a healthy discussion with the trade unions last Friday. They have apprehensions about some recommendations of the Pitroda committee report on BSNL. I cannot disclose any thing more than this about that meeting but I do hope they will call off their strike," Telecom Minister A Raja said on the sidelines of a conference in New Delhi.


Employees are protesting Pitroda panel's recommendations, which suggested voluntary retirement (VRS) to one lakh staff and 30 per cent disinvestment as part of improving the financial health of the PSU.


The strike call has been given by a joint forum of unions that has both executives and non-executives as members.


When contacted, BSNL Chairman and Managing Director Kuldeep Goyal said, "We are making efforts to ensure that services are not affected. Working on a contingency plan. We have about 10,000 senior staff, who are not participating in the strike, besides senior ITS cadre employees."


Goyal also said that a series of meetings were held with the striking unions but unfortunately they decided to go ahead with the strike.


Singh said about 50,000 executives and 2.50 lakh non-executive staff is participating in the strike and since almost entire technical staff will be on strike the services are bound to be affected.


BSNL saw profits plummet to Rs 178 crore in 2009-2010 (up to December 2009) from over Rs 575 crore in 2008-09 as the PSU is rapidly losing market share to new entrants. The PSU has 91 million users, both mobile and land line.


The Sam Pitroda panel was set up by Prime Minister Manmohan Singh to suggest ways to improve BSNL's financial health. The panel had banker Deepak Parekh and Telecom Secretary P J Thomas as members.


Besides the scrapping of the divestment plan, the unions are also demanding absorption of the 1,500 Indian Telecom Services (ITS) officers, who have been continuing on deputation for the last 10 years.


The unions are also protesting sharing of BSNL infrastructure, including cables and towers, with private telecom companies.

Telecom revenue falling.

On the face of it, the Indian telecom industry is booming. It not only the fastest growing industry in the country but also the second largest in the world (after China) with a subscriber base of 562 million at the end of December 2009. The main driver is wireless or mobile telephony whose subscriber base reached 525 million at the end of December 2009 quarter, 51 per cent higher than a year-ago period. Every month India adds around 12 to 15 million subscribers, highest in the world. All these superlatives, however, camouflage the real picture, that is, an industry heading for major trouble tottering under severe competition and self-inflicted price cuts.

Just look at some of the key indicators to judge the health. According to the latest industry status report prepared by the Telecom Regulatory Authority of India (TRAI), the average revenue per user (ARPU) for the quarter ending December 2009, for GSM (Global Standard for Mobile) service was only Rs 144 per month or 35 per cent lower than Rs 220 in the same quarter last year. In fact, ARPU has been declining every quarter since last year (See Chart). For the CDMA (Code Division Multiple Access) service, accounting for 20 per cent of the wireless market, the scene is much worse. Their ARPU per month was only Rs 82 in the December 2009 quarter against Rs 111 in the same quarter last year.

Revision of pension for absorbed BSNL pensioners 01 10 200 to 31 12 2006


16.04.2010:REVISION OF PENSION OF THE ABSORBED BSNL PENSIONERS RETIRED BETWEEN 1.10.2000 AND 31.12.2006: We find to our dismay that some proposals are being sent to DOT by some over enthusiastic persons and Organizations asking for the same fitment formula for revision of pension of the absorbed BSNL pensioners which was given to the Central Government employees and its past pensioners. DOT is also being asked to revise the pension w.e.f. 1.1.2006. Whatever may be their expectation out of these proposals, it appears that their references to DOT are counter productive and misplaced. One has to bear in mind that revision of pension of the past pensioners who do not get direct benefit of revision of pay scales whenever ordered, are governed under some settled principles and law. Revision of pension of past pensioners has to take place only from the date the pay scales of the serving employees are revised. Revision of pension of the past pensioners is directly linked with the revision of pay scales of the serving employees and also from the same date. Revision of pension of the absorbed BSNL pensioners is therefore due only w.e.f. 1.1.2007. It cannot be advanced to an earlier date. Let us not forget the cases of the CABs/PSUs where the pension of the absorbed past pensioners are revised following revision of pay scales of their serving employees. Already DOT has delayed revision of pension of the absorbed BSNL pensioners over one full year on the pretext of revision on presumptive CDA pay scales. Unfortunately at that time, some Unions and Executives' Associations of BSNL/MTNL continued to lend their support to this move apparently to help the unabsorbed ITS Group A Officers even at the cost of the BSNL pensioners. The proposals for CDA fitment formula w.e.f 1.1.2006 from the individuals/unions would only help the DOT to delay and deny revision of pension. Our Association had been consistently asking the DOT from the day one to revise the pension of the absorbed BSNL pensioners with the same fitment formula of 30% of the gross pension plus 78.2% of IDA and w.e.f. 1.1.2007 as granted to the serving PSU Employees by DPE. Q:        ITS association has blamed HMOC &IT for derailing the growth of BSNL?

A:         It seems a few ITS officers have been transferred from one section to other within the same station and ITSA is crying foul. But thousands of non executives are transferred by these ITS officers throughout the year willfully violating the transfer policy and guidelines issued BSNL Corporate Office from time to time. Even spouse and medical cases are not spared. Official who are due to retire within two or three years are also transferred without any justification or requirement costing the BSNL Crores of Rupees toward TA/DA and joining time pay. Some sadistic SSA heads and their agents are on prowl just to issue orders and latter cancel /modify./effect these transfers for oblivious reasons they take vengeance on those who do not toe to their lines and such cases are increasing year by year in the form of pick and choose victimization.

            But if a few ITS officers are transferred there is a hue and cry. In Kerala a particular officer has completed more than 20 years in the same station/SSA HQ. In Andhra many ITS officers completed their term and enjoying the stay in the same. It is strange that these officers are blaming the Minister.

            It is painful that neither the Circle Administration nor the Corporate Office Administration is intervening to check violation/victimization even represented by individuals/Service Unions. Flatly they refuse to intervene saying that they can do want to interfere in the Circle Administration even though they are convinced that the representations are genuine.

            It is a naked truth accepted by all quarters that the growth and sustenance of BSNL are shattered and the CO is going red this year is due to the failure of leadership, the reason for this failure is non absorption OF ITS in time.

20 04 10- 16 04 10 JAC meetings with the Minister,CMD,BSNL, etc.

Here is the brief of  the developments and discussions on our strike demands with Hon'ble minister of Communications , Sri A. Raja and with CMD BSNL


Meeting held with Honourable Minister Sri A.Raja today at 12.30 hours.
 JAC will review about indefinite strike call after meeting CMD this evening and on receiving    the minutes of meeting with the Minister.  
I.T.S. absorption: Note for process of absorption will be sent to Cabinet within 3 months.In the meantime the BSNL will recruit Dy.G.M.level officers and management trainees as contingency plan.
Wage Revision: DOT is contemplating to refer the matter to MOC on the plea of pension involvement. This was protested by union representatives as this has not been done in the case of Executives. Minister advised Secretary (T) for early approval of the case.
Disinvestment and VRS: JAC strongly opposed the disinvestment of BSNL and VRS to One Lakh Employees. Minister mentioned that both the issues has been recommended by Sam Pitroda Committee but he has already discussed the matter with the Prime Minister  and thereafter a letter has been issued by Principal Secretary to Prime Minister mentioning that the report first will be discussed in the Telecom Commission meeting and thereafter it will be sent to Group of Ministers (GOM) for considerations. The Govt. decision in this regard will be discussed with the BSNL Unions thereafter only implementation will take place.
Unbundling of last Copper Wire: MOC asked CMD, BSNL for optimum use of last Copper wire.
Pension Revision: Issue to be settled within one month if no Cabinet note is needed for circulation amongst other Ministries.In Case matter is required to be sent to Cabinet, 3 months time is required for settlement.
Procurement of Equipment for expansion of BSNL services: JAC expressed it's serious concern against BSNL Board's decision to scrap 93 Million GSM line tender on the advise of Sam Pitroda Committee Recommendations. When 2G GSM equipment in Phase VI tender is cheaper then Phase V GSM equipment. Minister clarified that BSNL Board is fully competent to take decision in this regard.
MOC appealed for postponement of Strike. JAC to wait for official minutes before acceding to the appeal of MOC.
JAC in its internal meeting after meeting the Minister analysed the discussions and decided that CMD BSNL/ DoT should clearly spell out the roadmap for the procurement of GSM equipments in BSNL for next one year and contingency plan in case ITS Officers do not opt BSNL.

 In the meeting with CMD, CMD has assured JAC that uninterrupted supply of required GSM equipment will be ensured till such time the managed capacity model is finalised. CMD said all options will be explored so that the development is not hampered.

    Prior tomeeting with HM(C) , JAC had a meeting with RLC at 11.30 Hrs RLC advised the workers to defer the strike as the matter is being considered at the highest level of the government. But JAC replied that unless the core issues are settled, strike can not be deferred.

     Both Sri K.Vallinayagam, G.S and Sri D.Chandrasekar, Offg. G.S (and AGS) met Dr. Sri Sanjeeva Reddy, President, INTUC at 20.00 Hrs and thanked him for extending support for the BSNL Workers strike. Dr.Reddy assured of his intervention in case there is hitch in settlement. He also assured suo motto of using his good office to clinch 78.2% IDA fixation benefits in wage revision.
JAC to meet on 19/4/2010
      JAC has decided to meet on Monday to take stock of the over all situation, consider assurances given by HM(C), Secretary DOT and CMD BSNL and will take a final decision on strike.

20 04 10 strike .JAC met Minister.

JAC met Hon'ble Minister of Communications today  and discussed all the issues related to strike call. Alongwith MOC, the CMD BSNL and Secretary DOT were also present during the discussions. The JAC is to meet CMD BSNL separately this evening to discuss about GSM Equipment purchase and immediate expansion of GSM lines. Details will be available after some hours. Raja-trying-to-derail-the-growth-of-BSNL-Officials-ITS Association protests.

The ITS Association feels that such motivated actions are ill-conceived and totally uncalled for and will prove counter-productive to the larger interests of BSNL. "Our members are highly disturbed and agitated on the issue of injustice and unnecessary harassment being meted out to them without any rationale," the letter says. ITS officers allege that Raja is deliberately delaying the process of procurement through the low cost, managed capacity model to force BSNL to place add-on orders on his favourite vendors. They have demanded the immediate withdrawal of all the transfer orders issued.
