What BSNLEU says about strike.

Two meetings took place today the 30-11-2010, in connection with the strike. The first meeting took    place in the afternoon  between the JAC leaders and the Regional Labour Commissioner. Later on, the CMD met the JAC leaders in the evening. But there was no result from both these meetings. Even though the strike notice was issued 45 days ago, so far the DOT Secretary did not even bother to call the JAC leaders for talks. From this we can understand how the government is neglecting BSNL. Finally the JAC met at 1700 hrs and reviewed the situation. All the  unions unanimously decided that the strike should take place as per the decision. No union had any difference in this decision. Hence, the entire Non Executives and Executives are requested to strike work from 0600hrs tomorrow the 01-12-2010 up to 0600 hrs on 04-12-2010.

The government had earlier formed a "National Do Not Call" (NDNC) Registry in 2007. However, consumers continued to complain about unsolicited commercial communications by way of calls, as well as SMSes.

Sources said that as per the revised recommendations, TRAI has proposed a fine of Rs. 25,000 for the first offence by a telemarketing company, which would go up to Rs. 75,000 in case of a second violation, Rs. 80,000 for the third, Rs. 1.25 lakh for the fourth, Rs. 1.50 lakh for the fifth and Rs. 2 lakh for the sixth offence, following which the number will be blocked by all service providers.

All the telemarketing companies will have to submit security deposits with the service providers in advance.

Similarly, the service providers would also be subject to hefty penalties ranging from up to Rs. 1 lakh for the first offence to up to Rs. 10 lakh for the fourth offence.

The Regional Labor Commissioner (RLC), New Delhi called JAC leaders & BSNL Management for conciliation Meeting Today & discussed in detail the demands of JAC & the view points of BSNL Management on demands.

After hearing both the parties RLC appealed, JAC to withdraw the agitation till the time BSNL Management / DoT Administration settle the demands. 

JAC requested RLC that , in case the demands of JAC are resolved, Three days strike call can be withdrawn otherwise agitation will continue. 


RLC issued notices to BSNL Management / DoT Administration for submitting their reply & attending a meeting with him tomorrow at 11.30 AM. RLC also invited JAC leaders for discussion tomorrow at 1400 hrs. 

The issue of 78.2% ida  merger was discussed. BSNL is of the view that 78.2% IDA can be given from now onwards and for retirees, benefits can be given like increase in pension terminal benefits etc. . Anyhow this matter to be taken upto DoT today and BSNL may come out some suggestions regarding 78.2% when JAC leaders meet tomorrow.Anyhow, 78.2% IDA merger, some thing can  be achieved. 


For us it cannot be sole motive for achieving it. What is the point in getting 78.2% IDA when BSNL is incurring loss ?Last year we escaped because of interest from cash reserves. For 2009-10,loss is to the extent of Rs.5955 crores. Because of interest, loss narrowed . The major worry is depcreation running to crores. That factor has to be viewed seriously.

NEW DELHI: New telecommunications minister Kapil Sibal has his work cut out — to pull out BSNL from its march on the road to ruin after it has emerged that the telco’s actual losses were nearly Rs 6,000 crore for the year ended March 10.

BSNL, which suffered from rampant political interference and neglect under former telecoms minister A Raja , had recently announced a loss of Rs 1,823 crore for the year to March, a first for the company since it was set up. But financials uploaded by the telco on its website reveal that losses were as high as Rs 5,955 crore for this period. In fact the losses would have have been much higher but for the Rs 4,132 crore income from non-telecom-related activities . Off this, about Rs 2500 crore was from interest on its cash reserves , which too dipped to Rs 28,660 crore from Rs 40,000 crore in 2008.

The financial performance of BSNL, once a monopoly in domestic telephony, has been deteriorating over the years as it could not expand on time to compete with private mobile phone firms, such as Bharti Airtel, which took decisions quickly.

Executives with the telco point out that political interference coupled with legal challenges and probes into its tenders for mobile networks resulted in the telco being able to increase its mobile capacity by a mere 20 million since 2005, even as the country added over 450 million mobile users during this time. BSNL’s initial tender for 63 million global system for mobile communications (GSM) in 2006 was slashed to 23 million by Mr Raja in what was his first major decision after taking charge of the ministry.

This tender was further cut to 14 million lines after Nokia Siemens Networks (NSN) that was slated to supply 40% of the contract failed to do so. Its follow-on tender for 93 million GSM lines, the world’s largest equipment order , was cancelled after a series of controversies, even as rivals such as Bharti, Reliance Communications and the Tatas expanded to feed the expanding customer base.

The Parliamentary Accounts Committee had recently pointed out that the ‘single most important reason’ behind BSNL’s decline was failure of the tendering process, leading to non-supply of equipment , which eventually resulted in the stare-owned operator losing market share.

It is still a mystery how these public sector banks granted loans to these tainted companies when investigations were being conducted under the provisions of criminal conspiracy (Section 120 B of IPC) and Section 13 D of the Prevention of Corruption Act, besides several court cases going on for the past two years on the validity of these telecom licences.

The banks had provided huge loans to these companies based only on the telecom licence paper.

The Department of Telecom is a party to most of these loans and controversial officers AK Srivastava and PK Mittal, who are under the CBI radar, are the signatories to these high-volume deals. “Without the consent of political masters, these officials won’t become signatories to such high-volume loans,” said a top DoT official.

According to the CAG report, the telecom licences and spectrum allotted to Swan (15), Unitech (22), Datacom (21), Loop (21) and STel (six) are illegal and require immediate cancellation as per the Department of Telecom guidelines.

Investigating agencies on the trail of senior home ministry official Ravi Inder Singh, who is suspected to have leaked sensitive information to corporate houses, have zeroed in on another lobbyist — Deepak Talwar.
Talwar was instrumental in getting all the clearances for telecom company Telecordia from various agencies and departments despite objections on the grounds of security, investigations have revealed. The agencies are probing the lobbyist’s role not only in the Telecordia case but also in a number of other cases in the aviation and other sectors.
Highly-placed sources say that Singh, a West Bengal cadre IAS officer posted as director in the Union home ministry, gave clearance to the telecom company despite objections from intelligence agencies such as IB and RAW as it had operations in Pakistan.

After reporting losses at the end of last fiscal, Bharat Sanchar Nigam Ltd has now gone cash negative further plunging the telecom company into deep financial mess.
BSNL has decided to borrow Rs 3,000 crore to meet routine expenses including salary payments for the current financial year and another Rs 11,000 crore for the fiscal 2011-12.
This comes even as the PSU has asked the Government for a bailout package including full refund of the money paid for 3G and broadband spectrum and financial support for rolling out broadband services in rural areas.
BSNL has been struggling over the past two years owing to delays in buying network equipment, political interference and a messed up roll out of 3G and broadband services despite getting spectrum one year ahead of the other players.

CMD BSNL invited JAC leaders to discuss about the Three days strike call & demands. CMD in the presence of ED(F), Sr. GM(SR), Sr. GM(Estt.), PGM (Regulation), Sr. GM(ERP), PGM(CDR Proj.)  & other Senior Officers.

CMD BSNL discussed & apprised the Govt's /BSNL's stand on the JAC demands i.e. 30% disinvestment, VRS to One lakh employees, Unbundling of BSNL Copper Conductor are not being decided by Govt. immediately. 

Regarding ITS absorption issue, IDA Pension Revision; DoT is pursuing with the Cabinet. 

Regarding procurement of 5.5 million GSM lines equipment BSNL is evaluating the Financial Bids and shortly decision will be taken.

Regarding 78.2% IDA fitment benefit; CMD further re-iterated that issue will be considered when BSNL makes profit.

During discussion, JAC leaders expressed serious resentment against DoT/BSNL Management lack of concern for the settlement of the demands & JAC Three days strike call where the notice was served one month before. JAC leaders categorically told that Administrative Ministry should  come out with concrete solution of the demands & BSNL Management should immediately implement 78.2% IDA fitment benefit.

However JAC leaders will meet on Monday to review the developments. All the Circle / Branch Secretaries are requested to mobilize for an active participation to make Three days strike grand success.

Our comments: This news is not a shocking one. Already many companies in India are having huge debts and making profits. 
BSNL was formed due to various compulsions. 
Staff were recruited based on justifications during the year 1970s and 1980s.
Today, what is the need for BSNL to cater rural areas?
Only BSNL has to cater rural areas and not other private operators.They are ready to pay levy for not rolling of telecom operations. 
We must join together to fight to get refund for maintaining rural services from the govt. Or we can go out of rural areas. 
Loss is mainly due to operational costs of rural areas.
Less tariff, problems galore in getting equipments. etc. 
There is no point in commenting huge work force. Becasue BSNL was formed from DoT.Moreover it is also not fair to compare BSNL to other public sectors as we have to cater common people. 
So we all try to increase revenue to BSNL.
Still BSNL lacks in various fields. 
Loss is only temporary and we can make it to a profitable one if all united work.

CBI starts building case against Raja-DNA

The CBI has begun tightening the noose around telecom companies in a bid to gather clinching evidence against Raja.
The CBI is believed to have questioned the top brass of spectrum scandal-ridden firm, Swan Telecom, and its owner Shahid Balwa over the past two days. CBI sources said Balwa was asked how the scam was engineered. Swan Telecom allegedly bagged 2G licences for operating in 13 circles by paying Rs1,537 crore. Within months, it sold 45% of its shares to UAE telecom giant Etisalat for a whopping Rs4,500 crore.

According to BRPSE chief Nitish Sengupta, “It seems the company has a lot of problems and is not being able to compete with private players in a fast expanding market. It lacks consumer susceptibility and has an excessive workforce. We will discuss all these issues before making a blueprint for its revival.” Sources in BRPSE claimed that during his tenure, Raja was not keen to apply the BRPSE prescription for BSNL.
Earlier, BRPSE had recommended that the ailing Indian Telephone Industries (ITI) be taken over by BSNL as the former is well known for manufacturing equipment for the telecom industry. “But we faced stiff resistance from the then minister, A Raja, who refused to accept our suggestions,” Sengupta told Business Standard.
ITI has a plant in Raebareli, the Lok Sabha constituency of Congress President Sonia Gandhi.
Gandhi was also keen to see ITI become a BSNL subsidiary but Raja didn’t allow it in his tenure.
BRPSE, however, will not take up the merger issue in its forthcoming meeting as it wants to focus only on the financial health of BSNL.

Cellular Operators Association of India (COAI) today indicated that profits of mobile telecom industry may shrink further on account of strict subscriber verification norms and levy of charges on erection of cell towers by the state governments.
Lack of infrastructure facilities in rural areas coupled with stringent norms of customer verification before providing services is a deterrent for mobile penetration in most parts of the country, COIA Director-General Rajan S Mathews said.Operators spend crores of rupees on customer verification process. Right now, activating one customer includes a minimum expense of Rs 600-700. Also, the state governments have started levying taxes on cell tower.In Delhi, till recently they (state government) were charging 50,000 per tower. It has now further been enhanced to Rs 5 lakh.These are going to kill our profitability, Mathews told PTI.

The consumer-friendly service was mooted over two years ago and was planned to be implemented by the end of 2009. However, implementation had to be deferred several times owing to reasons ranging from lack of preparedness of operators to delay in appointment of an agency to oversee MNP execution.
There are eight mobile operators in Haryana: Airtel, Idea Cellular, BSNL, Aircel, Loop, Vodafone, Etisalat and Videocon. For now, MNP will be allowed only within circles. The customer will have to pay a maximum of Rs. 19 to the new operator to change network and the new operator has the option to waive off the fee or reduce it. But the minimum stay period with one operator for consumer is three months. Both pre-paid and post-paid consumers can use MNP.

The Supreme Court reserved its verdict on the petition of Dr Subramanian Swamy seeking directions to the Prime Minister Manmohan Singh to grant sanction for prosecution of ex-telecom minister A Raja in Rs 1.76 lakh crores 2G spectrum scam.

A bench comprising Justices G S Singhvi and A K Ganguly reserved the judgement after hearing Attorney General G E Vahanvati on behalf of the PM and Dr Swamy in person.

The main contention of Vahanvati was that the application of the petitioner was premature as the application for sanction cannot be entertained unless and until the complaint has been filed in the court and the court has taken cognisance.

The CBI has been asked by the Supreme Court to explain why A Raja has not been questioned about his alleged role in the 2G scam.

The court said the CBI "was beating around the bush" by not questioning either Raja or the Telecom Secretary.  The court said a report by the government's auditor which severely indicted Raja for deliberately undervaluing 2G spectrum should have prompted the CBI to question the former minister

"Any responsible person will question the involvement of the Minister and the Secretary and you (CBI) say that 8,000 documents have been examined. You are beating around the bush. It (questioning) was the minimum expected of the CBI. What do you take this court for?" asked the two judges hearing the 2G case.

25.11.2010 (UNI) The Centre has no proposal to withdraw the national roaming charges on mobile phones.

In a written reply, Minister of State for Communications and Technology Sachin Pilot informed the Rajya Sabha that at present, the government has no such proposal to withdraw the national roaming charges on mobile phones.

To a question if the government also proposes to bring a zero rental scheme for the benefit of post-paid mobile users, Mr Pilot replied, ‘Regulation of tariff has been mandated to the Telecom Regulatory Authority of India (TRAI) vide the TRAI Act of 1997. As per the current tariff framework in vogue, tariff for mobile services is under forbearance except for roaming services. The operators have flexibility to offer different tariff package including zero rental schemes targeted at different customer user groups, subject to the condition that these tariffs have to be consistent with the regulatory principles of non-discrimination, non-predation and inter-connection usage charges compliance and are to be reported to TRAI within seven days of introduction.’ UNI

Shri  A. Raja has resigned as MOC and handed over his resignation letter to Hon’ble PM on 14th November, 2010 night, in the wake of Supreme Court hearing on 2G Spectrum Allotment Issue.
Tenure of Shri A. Raja as Telecom Minister will be remembered for his positive decisions on granting of check off facility to BSNL Unions, 50% IDA Merger for BSNL Workers and many pro-worker decisions.
He facilitated the increase of tele-density in the country as well as steep reeducation in telecom service charges which were beneficial to people.
On our special request, Shri A. Raja was pursuing revision of Pension for pre.01./01.2007 BSNL Retirees and the same is likely to be cleared by the Cabinet in the near future.

The 2G spectrum scam has turned out to be the biggest scandal that independent India has seen. The tainted A. Raja has resigned from the Telecom Minister post. But it has been revealed that many corporate houses and govt. officers are also involved in this scam. The Supreme Court has indicted the CBI as well as the Prime Minister Manmohan Singh for their inaction in this scandal.

.இது குறித்து, இச்சங்கத்தின் டைரக்டர் ஜெனரல் ராஜன் மாத்யூஸ் கூறியதாவது:மொபைல் போன் சந்தாதாரர்களுக்கு, சேவையை வழங்குவதற்கு முன்பாக, அவர்கள் தொடர்பான விசாரணையில் கடும் விதிகள் பின்பற்றப்படுவதால், பல்வேறு இடங்களில் மொபைல் ஆபரேட்டர்களுக்கு கடும் சிக்கல் ஏற்படுகிறது. சந்தாதாரர் தொடர்பான விசாரணைக்கு மட்டுமே கோடிக்கணக்கான ரூபாயை ஆபரேட்டர்கள் செலவிட வேண்டியுள்ளது. 

தற்போதைய நிலையில், ஒரு சந்தாதாரருக்கு 600 முதல் 700 ரூபாய் வரை செலவாகிறது.மேலும், கிராமப்புறங்களில் கட்டுமான வசதிகள் போதுமான அளவில் இல்லை. மேலும், மொபைல்போன் டவர்களுக்கு மாநில அரசுகள் வரி விதிக்க துவங்கியுள்ளன.டில்லியை எடுத்துக்கொண்டால், ஒரு மொபைல் போன் டவர் அமைப்பதற்கு 50 ஆயிரம் ரூபாய் செலுத்தவேண்டியுள்ளது. இது விரைவில் ஐந்து லட்சமாக உயர்த்தப்பட உள்ளது.

நசிந்து வரும் இத்தொழிலால் ஏற்கனவே பல ஆபரேட்டர்களுக்கு நஷ்டம் ஏற்பட்டுள்ளது. தற்போது இத்தொழிலில் புதுப் புது முன்னேற்றங்கள் புகுத்தப்படுவதால், நிலைமை இன்னும் மோசமாகிக் கொண்டு இருக்கிறது.தற்போது நிகர லாபம் 8 முதல் 10 சதவீதம் என்ற அளவில் தான் இருக்கிறது. இதிலிருந்து இன்னும் இரண்டு, மூன்று சதவீதங்கள் குறைய வாய்ப்பு இருக்கிறது. 

சில ஆபரேட்டர்கள் நிலைமை நஷ்டத்தில் உள்ளது.இதில், ஒன்று இரண்டு ஆபரேட்டர்கள் தப்பித்தோம் பிழைத்தோம் என இருக்கின்றனர். மற்ற ஆபரேட்டர்களின் லாபம், கடந்தாண்டுடன் ஒப்பிடும்போது, இரண்டாம் காலாண்டில் குறைந்துள்ளது.மொபைல் போன் சேவையில் பிரபலமாக உள்ள 

பாரதி ஏர்டெல் நிறுவனம் லாபம் 27 சதவீதம் குறைந்துள்ளது. டாடா டெலிசர்வீசஸ் மகாராஷ்டிரா நிறுவனத்தின் லாபம் இரண்டாம் காலாண்டில் 97 கோடி ரூபாயாக உள்ளது. இது 9 சதவீதம் குறைந்துள்ளது. கடந்தாண்டு இதே காலகட்டத்தில் 108 கோடி ரூபாய் லாபம் கிடைத்திருந்தது.இவ்வாறு ராஜன் மாத்யூஸ் கூறினார்.மத்திய தகவல் தொடர்பு துறை, மத்திய உள்துறை அமைச்சகத்தின் உத்தரவின் பேரில், மொத்தமுள்ள 70 கோடி மொபைல் போன் வாடிக்கையாளர்கள் பற்றி மீண்டும் விசாரணை நடத்த உத்தரவிட்டது.

மும்பை போலீசார் சமீபத்தில் நடத்திய அதிரடி சோதனையில், பிரி-பெய்டு சந்தாதாரர்களில் 60 சதவீதம் பேர் போலியான ஆவணங்களைக் காட்டி சிம் கார்டு பெற்றுள்ளது தெரிந்துள்ளது.நாட்டிலுள்ள மொபைல் போன் சந்தாதாரர்கள் எண்ணிக்கை 70 கோடி. இதில் ஈடுபட்டுள்ள நிறுவனங்கள் முதலீடு செய்துள்ள தொகை, ஒரு லட்சத்து 50 ஆயிரம் கோடி ரூபாய். மேலும், இந்தியாவில் தான் கட்டணங்கள் குறைவாக உள்ளன.

Indicating that a court-monitored probe was required in the 2G Spectrum scam, allegedly involving disgraced former telecom minister A Raja, the Supreme Court on Wednesday said that the scam is the mother of all scams put together.
A Bench comprising justices G S Singhvi and A K Ganguly said that “given the magnitude of amount allegedly involved in the scam, it might need monitoring of the probe…The case must be investigated efficiently, diligently and expeditiously... This scam will put to shame all other scams put together.” It further said: “We hope the Centre would not have any objection. What would be the method of monitor would be looked into.’’
Advocate Prashant Bhushan, appearing for the CPIL, said a panel of one or two retired CBI or IPS officers might be formed to monitor the case on day-to-day basis. “There are many universally-acclaimed retired officers who can supervise,” he said.

CHQ calls to hold protest demonstrations on 2G spectrum scam
The 2G spectrum scam has turned out to be the biggest scandal that independent India has seen. The tainted A. Raja has resigned from the Telecom Minister post. But it has been revealed that many corporate houses and govt. officers are also involved in this scam. The Supreme Court has indicted the CBI as well as the Prime Minister Manmohan Singh for their inaction in this scandal.
The Central Secretariat of BSNLEU, which met on 22.11.2010 has decided to call upon the branches to hold protest demonstrations on 27.11.2010 demanding:-
i)                   To prosecute immediately all the individuals and companies who are involved in the 2G spectrum scam.
ii)                Recovery of the entire amount from the individuals and companies who have swindled money in the 2G spectrum scam.

It has allowed sacking of the non-performing staff in PSUs-Nodal agency?

Indian PSUs are not particularly known to feature in the reckoning of companies with highest efficiency; profitability or pay scales. Such has been their reputation that the best and brightest minds often leave them for greener pastures. But all of that is set to change for the better. And with the right results may even end up being the inflection point for Indian PSUs.

The PSUs are typically armed with legacy assets at very cheap costs. Ideally, these companies should easily give their private sector counterparts a run for their money. But inefficient execution and aversion to adopt technological changes has deprived them of high margins for years. The bane of contention has been very strict labour laws governing them. The latest approval from the nodal agency for India's 246 state-run companies thus comes as a welcome relief. It has allowed sacking of the non-performing staff in PSUs. The number could go up to 10% of the total workforce. This landmark decision could pave the way for companies to rationalize employee base. In addition, they could aim at improved efficiency and quality. The move to align pay scales based on employee performance could also become the bait for attracting skilled workforce. And not to mention the ability to compete effectively with the private sector.

This move may be seen as the government's attempt at making PSUs more attractive and stimulate its disinvestment plans. Nevertheless, given that the Navratnas (9 largest PSUs) alone contributed 16% of the country's GDP in FY10 (according to D&B), their higher profitability would certainly be in the interest of minority shareholders as well.

BSNL-to-get-Rs-2395-cr-grant-for-rural-WiMax-rollout

BSNL will be given a grant of Rs 2,395 crore with a list of riders to enable the telco to complete the rollout of its wireless broadband services, an official in the telecom ministry aware of the development told ET.

Last month, BSNL had blared its disgust at operating as a social workhorse without compensation, and the state-owned telco had bluntly told the government that it would continue building wireless internet services across rural India only with a grant of Rs 2,395 crore more to support an unviable business.

The state-owned telecom company, which offers services in all parts of the country except Delhi and Mumbai, had written to the telecom department stating that it is against rolling out services on the rural WiMAX project on a no-profit/loss basis without adequate financial support.

PAC looks CAG report.

Even as a political battle for a joint parliamentary committee (JPC) to probe the 2G spectrum scandal rages and the Opposition's demand has been stalling Parliament for two weeks, the Public Accounts Committee (PAC) has quietly begun looking at the scam and the CAG report on the subject.
The first meeting of the PAC, chaired by Bharatiya Janata Party leader Murli Manohar Joshi, after the CAG report was tabled in Parliament, was held on Monday; each committee member was given a copy of the report and asked to read it and frame relevant queries that would be sent to the Ministry of Communications and Information Technology for answers.
But even before this, the PAC has begun taking evidence on record from key figures. Apparently, the former Telecom Secretary, P.J. Thomas, whose appointment as Chief Vigilance Commissioner is now before the Supreme Court, has already given some evidence to the PAC, as have the former chairman of the Telecom Regulatory Authority of India, Nripendra Misra, and Finance Secretary Ashok Chawla.

In what is turning out to be a case of industrial espionage, investigators believe Ravi Inder Singh, the Director in the Union Ministry of Home Affairs (MHA) who was detained by the Delhi Police on Monday, could have been leaking information to telecom companies through an acquaintance called Vineet. Sources said some of the information made available by the 1994-batch West Bengal cadre IAS officer to Vineet — who runs a food processing unit in Bengal — could have been accessed by Chinese companies doing business in India.
Sources said Singh was in constant touch with Vineet, who was acting as a “broker” on his behalf. Vineet was arrested by the Delhi Police Special Cell from a five-star hotel on Monday evening. During the five-month-long investigation by the Special Cell and the Intelligence Bureau, it was established that Singh was using five mobile phones, all of which have been recovered by the police, they added. The Delhi Police, which has been questioning Singh since Monday under Section 160 of the CrPC, placed him and Vineet under arrest late on Tuesday night.

Whether strike by JAC will be successful?

JAC Meeting held on 22.11.2010 at BSNLMS Office reviewed the progress over our strike demands.  FNTO expressed that the following factors should be kept in mind while deciding to go on strike as per schedule or otherwise.
1.         DoT committee on Pitroda Recommendations has duly addressed two crucial issues of disinvestment and VRS and has decided not to go ahead with Pitroda Recommendations on these issues.
2.         A new telecom minister has just taken over and sometime had to be given o him for looking into the pending issues.
             However, the general consensus among Unions and executive associations was for strike as per schedule if there is no serious   intervention from the Government or Chief Labour Commissioner.
Comments: FNTO has openly said in the JAC meeting that a new Telecom Minister has been appointed, VRS and Disinvestment -the govt. is not going ahead regarding implementation immediately. 
It was also openly said that these factors may be taken before going in for 3 days strike.  After expressing the views, it is clear from the above article, that FNTO has accepted the majority unions views and has started preparing for 3 days strike as called by JAC. 

The Tamil nadu JAC was also convened and FNTO was also a party to the Tamil Nadu JAC circular. 

What made BSNLEU to comment that "Some have started floating the idea that a new minister has been appointed, disinvestment will be done after some"

Only from the FNTO web, it is clear that this statement was made by FNTO in the JAC meeting. Whether other unions have also expressed the same view?

What are the reasons for calling JAC?
Whether JAC is a iron citadel so that none should express their views?
Whether all have to follow the dictat as told by JAC?
Whether participating union has no freedom to express their views?
FNTO has agreed to follow the majority views and decided to participate in the 3 days strike and what is the need to comment on the matter discussed within JAC? 
FNTO successfully participated in one day strike called by all trade unions? Is it not known to all?
Whether plans are afoot to jeopardise the three days strike called by JAC?
Is this the way to scuttle the 3 days strike silently?

JAC is carry on the views of all and to implement programmes by coordinating all unions.  
Whether JAC is  to criticise other unions because of not following or toeing the line of JAC?
Unity is of paramount importance to carry struggles. Whatever be the minor skirmishes, all have to be ignored and we must try to achieve the goal. If criticising others, what is going to be in store?

Whether this comment is to make others not to participate in strike or to make more efforts to participate in the strike?

It is better to go on with the struggle to save BSNL and need not waste time in things which happen inside or outside JAC. 

Whether the strike by JAC is going to be successful or not. We will wait and see.

NEW DELHI – On Wednesday India's Supreme Court will continue the hearing of a petition by opposition politician Subramanian Swamy seeking permission to prosecute former telecommunications minister A. Raja, who resigned from his post earlier this month.
Mr. Swamy, who is president of the Janata Party, first sought approval to pursue a legal case against Mr. Raja back in 2008. Permission was needed as Mr. Raja was in public office at the time.
Mr. Swamy wanted to pursue a legal case against Raja over the allotment of licenses and spectrum bandwidth to telecom companies in January 2008. He wrote to Prime Minister Manmohan Singh in November 2008 seeking approval for the case and then later petitioned the courts.
A lower court dismissed his petition earlier this year, but then a case was filed to the Supreme Court, which began its hearing in September.
Mr. Raja eventually resigned on Nov. 14 over allegations that his ministry in allocated spectrum and telecom licenses in an irregular manner and at discounted prices, resulting in an estimated revenue loss of $40 billion to the government.

India's main opposition party on Tuesday vowed to keep the national parliament deadlocked until the government agreed to a cross-party probe into allegations of a massive telecom corruption scam.
The Bharatiya Janata Party (BJP) and other opposition groups have forced constant adjournments in parliament for two weeks as Prime Minister Manmohan Singh has come under increasing pressure over his handling of the scandal.
"Two-thirds of the house members are demanding a joint parliamentary committee probe, why is the government denying their demand? It is a democratic demand," BJP spokesman Prakash Javdekar told AFP.
"The prime minister should resign if he believes in democracy."

PM Blames Law Ministry 2 G inaction-affidavit-NDTV

Law minister M. Veerappa Moily approved the advice on January 26, 2010. The only excuse for the delay in giving legal advice seems to be the fact that on June 8, 2009, the law ministry stated that it had called for the views of the Department of Telecommunications (DoT) to examine the matter in the "right perspective". Interestingly, the PMO had already referred the matter to the DoT on March 24, 2009, over two months before it was referred to the law ministry.
On March 25, a director in the PMO dealing with telecom, Amit Agarwal, wrote to the DoT asking it to send a suitable reply to Swamy. Raja, subsequently, wrote to Swamy on June 18, 2009, stating that his demand was not justified.
With the Prime Minister yet to reply, Swamy sent reminders to Singh after the CBI registered an FIR in the matter. With the PMO having sought legal advice five months before the registration of the FIR, the subsequent letters by Swamy were also forwarded to the law ministry. Though Swamy had pointed to the CBI case to state that sanction was now a mere formality, the law ministry stated that since Swamy had himself the referred to the CBI probe, the Prime Minister should wait till evidence was collected by the agency.

However, Mr Raja and Mr Chandolia misused the Pitroda Committee report and formed a search committee filled up by their own people, alleged Telecom Watchdog, secretary, Mr Anil Kumar.
He said that the duo changed the conditions so that only their own favourite could qualify for the appointment of the new CMDs. “Around 170 people had applied for these two posts. But on Sunday when common wealth game was being held in Delhi, they suddenly called only 12 people for interview and that too when the cabinet secretary was not present. Just like they had done in 2G scam,” said Mr Kumar.
The next day Mr Raja took five people to meet the cabinet secretary and Mr Upadhyay and Mr Singh were selected for the post of CMD BSNL and MTNL, respectively, added Mr Kumar.

In response to series of communication that this Assn had with National Commission for Women regarding taking a very stern action against Sri R. K. Dawra, GM Ambala for his sexual harassment towards a young JTO at Ambala Circle office, and also the protection given to the culprit by CGM Haryana by not filing an FIR against the accused in accordance to the guidelines of Hon Supreme Court and orders of DOP&T, National Commission for Women has directed BSNL to take very tough and appropriate action against the accused and report compliance to it. It is understood that appropriate action against the accused(GM) is being taken by the competent authority now. Assn shall, however pursue the matter further with the National Commission for Women for directing BSNL to take appropriate action against the CGM, Haryana also for shielding the action of the accused and not filing FIR.

Comment: For FNTO , 3 unions have come to support the front. As such, FNTO is in a position to form a separate front and want to fight this election in its name. 

Now NFTE claims support of 5 unions. NFTE wants to defeat BSNLEU this time. NFTE also welcomes all other unions to its fold. 

What about the agreeement signed by NFTE with FNTO in the 4th verificiation?
Whether the agreement has to be honoured by NFTE or not?
If 8 and more unions join together and fight this verification in the name of FNTO, BSNLEU has to work hard.
There are chances for FNTO front with support of NFTE to come first in this verification.
BSNLEU has more difficulties in this election:

No Bonus.

BSNL is running loss.

Non Executive promotion policy-arrears to some, recoveries to many.

Transfers problem.
Anamoly issues not settled in favour of employees.

Lot of things for discussion. 
If all unions join together and fight this verification in the name of FNTO in the interest of workers,surely FNTO front will emerge winners. 

FNTO welcomes all unions to its front and face this verification, do justice for workers and make BSNL to get into profit zone .

Heed-TRAI-start-cleanup-now

With the Trai recommendation coming in, the government should act on it with dispatch unless it wishes to be regarded with suspicion even with Mr Raja gone. Noises are already being made about customers being harmed if the licences are taken away. Some would rather that penalties weren’t collected, arguing speciously that these are enormous. The offending companies claim to have 1.3 crore subscribers, but there could be a well-founded view that the real figures might be just half of this. So it won’t be a big deal if the licences are indeed revoked, repudiating the self-serving arguments being advanced. Let us not reward the offenders.

A provision in the licence says that if for some reason a party cannot fulfil its obligations, then the government can take it over. Thus, it could be that either BSNL or MTNL can take over the subscribers who might find themselves at a loose end. Another measure that needs to be adopted is to auction the spectrum that has been taken over to the existing serious players, whose could number about 200 out of the 575 who applied for licences.

The government on Saturday filed an affidavit in the Supreme Court on behalf of Prime Minister Manmohan Singh rejecting the charge of inaction on the part of his office in dealing with the request of sanction for prosecution of former Telecom Minister A Raja in the 2G spectrum issue.

The 11-page affidavit, filed through Director, PMO, V Vidyawati, stated that there was no inaction on the part of the PMO on the complaint filed by Janata Party President and former Law Minister Subramanian Swamy seeking the sanction for prosecution of Raja. It lists how Swamy's letters to the PM were adequately dealt with.

It also says that the PMO had sought the views of the Law Ministry on Swamy's plea, which could not be granted as the Central Bureau of Investigation (CBI) was investigating the case.
