KOLKATA: State-run Bharat Sanchar Nigam Ltd will consider for re-employment in senior management slots only officers of the Indian Telecom Service who have at least two years of service left, according to a senior company executive.

The teleco's new recruitment rules will exclude most of the 44-odd Indian Telecom Service (ITS) officers of the rank of chief general manager (CGM) from being considered for re-absorption, as they fall in the over-58 age group. The retirement age at BSNL is 60.

"It's pointless bringing in senior executives on board who have less than two years of service left. As a result, many ITS officers of the rank of CGM may not be eligible for re-employment as they are already over 58," a top company executive with direct knowledge of the matter said.

Whether BSNL has to pay?-Economic Times.

NEW DELHI: In a move that may put huge financial burden on old GSM operators, the Telecom Commission has said that one-time charge for extra spectrum beyond the contracted limit of 6.2 MHz held by these players cannot be ruled out.

"Levy of one-time fee cannot be ruled out," Telecom Commission Chairman and Telecom Secretary R Chandrasekhar said.

Leading telecom operators including Bharti, Vodafone and Idea, have been opposing this saying there was no such clause in the telecom licences under which this type of levy can be imposed.

Moreover, these operators have claimed that allotment of spectrum to them was as per the policy of the day.

The one-time fee was recommended by telecom regulator Trai and the amount was computed by experts.

First: The Draft National Competition Policy, 2011, that inter alia seeks separation of the policymaking, regulatory and operating functions. For instance, the department of telecom (DoT) decides telecom policy, it oversees the Telecom Regulatory Authority of India, and also owns BSNL and MTNL. How can one expect the DoT to be impartial when disputes arise between the regulator and an operator.

The Trai Act, 1997, would not have been replaced by the Trai (Amendment) Act, 2000, if a spat between BSNL and Trai had not taken place. The DoT was unhappy that Trai was not heeding its advice, but nothing could be done as the law did not allow for sacking of the regulator easily. So, that government did a wicked thing: it scrapped the law and adopted a new one that now provided for an easier removal procedure.

Both the Trai Acts had empowered the government to issue policy directives, an anachronistic device, but its use was not made when the Trai was implementing the law as defined under the 1997 Act.

BSNL to go for in ITS again?



While over 300-odd ITS officers have already reported to the telecom department's technical wing, the Telecom Engineering Centre, most don't have much work. It is precisely this situation that the BSNL leadership is trying to cash-in by setting in motion a special emergency recruitment drive to buy back the best ITS talent that is available. A selection board will shortly be constituted to complete the process in the next three months.

"We are looking at hiring 400 executives in the rank of DGM and another 300-odd in the rank of GM and above. We will only target ITS officers in the first phase. In case, the numbers prove hard to come by, we will have to take the more expensive route of poaching top industry talent from the private sector," said another BSNL executive familiar with the matter.

A BSNL employee has turned out to be a militant mole planted by Hizbul Mujhadeen to secure SIM cards and WLL phones for regenerating the outfit�s communication network in apple-rich town of Sopore in north Kashmir district of Baramulla.
Police have arrested Sajad Ahmad Dar working with BSNL Sopore as contractual employee for providing 10 SIM cards and one WLL connection to Hizbul Mujhadeen militants.�
�The accused, is a contractual employee with BSNL and IT expert, has been working for Hizbul Mujahideen for about one year�, said Mir Imitiyaz Hussain, Superintendent of Police, Sopore.
The modus operandi of the accused included securing SIM cards and WLL connection on fake names and addresses which was in turn supplied to militants.
Ahmad was carrying the illegal activity in connivance of some other accused that are yet to be arrested.� A case� has been registered and investigation has begun.
This is, however, not the first time that militant attempt to secure SIM cards has been unearthed in Jammu and Kashmir.
Thousands of SIM cards were deactivated by various mobile service providers in J&K this summer after reports surfaced about these being used by militants for communication.
A private mobile service provided disabled over 10,000 SIM cards in the state in 2007 after intelligence agencies tipped them off about these being used by the militants.

BSNL sought Rs.9306 crores for rural lines.-Minister. says

Replying to another question, Deora informed that BSNL has sought support of Rs 9,306 crore per annum from the USOF toward the Rural Direct Exchange Lines (R-DEL) scheme following expiry of the current subsidy support of Rs 2,000 crore per annum given to BSNL for the period of three years from July 19, 2008, to July 17, 2011.

On another question related to cases of corruption reported in BSNL and MTNL, Deora said during the last three years and the current year, the total number of corruption cases reported in BSNL stood at 36, while it stood at 22 for MTNL.

Rule 37 A - 11 A.CCS Pension Rules.

Sub Rule(37A)11. The benefits of pension and family pension shall be available to quasi-permanent and temporary transferred Government servants after they have been confirmed in the Public Sector Undertaking or Autonomous Body.
2[ (11-A) A permanent Government servant absorbed in a Public Sector Undertaking / Autonomous Body or a temporary / quasi-permanent Government servant who has been confirmed in the Public Sector Undertaking / Autonomous Body subsequent to his absorption therein, shall be eligible to seek Voluntary Retirement after completing 10 years of qualifying service with the Government and the Autonomous Body / Public Sector Undertaking taken together, and he / she shall be eligible for pro rata pensionary benefits on the basis of combined qualifying service. ]

Salary 2.89 crores -No work?

History has been created in the Government of India (GoI) as 387 Indian Telecom Service (ITS) officers received last month's salary for sitting idle. They were paid Rs. 2.89 crore.

Unlike the past Indian Telecom Service (ITS) officers are vigorously looking for deputations in the Government of India (GoI). This has been necessitated as all Indian Telecom Service (ITS) officers belonging to ranks of Junior Administrative Grade (JAG), Senior Administrative Grade (SAG) and Higher Administrative Grade (HAG) who were serving in the Bharat Sanchar Nigam Ltd (BSNL) and Mahanagar Telecom Ltd (MTNL) stood repatriated to the Department of Telecommunications (DoT) since November 8, 2011.However, so far 387 ITS officers have been relieved.

New Delhi: The Telecom Ministry is likely to auction one slot of broadband wireless access (BWA) licence spectrum on pan-India basis after getting back airwaves from the state-run PSU BSNL.
The Department of Telecom (DoT) has given in-principle approval to the proposal of BSNL to surrender its BWA licence in nine circles, out of the total 22 service areas for which the telecom operator had paid over Rs 8,500 crore last year.
"After taking BWA spectrum from the BSNL, the government will have airwaves on pan-India basis as the department is already having the spectrum in several circles. So, the government will auction it and whatever the amount they will get, BSNL is likely to get back around 80 to 90 per cent of what it had paid last year, about Rs 6,700 crore," sources in the know said.

How many active subscribers in telecom?

The message seems to be that low tariff does not buy loyalty and regularity of use. Spread uniformly across almost all the states they operate, those with highest proportion of active users are Bharti Airtel (88.8 per cent), Idea Cellular (92 per cent) and Vodafone (82.8 per cent).
Not surprisingly, the ARPU (average revenue per user) of these three mobile services players is the highest in the industry. Among other pan-India players, Reliance Communications has just 64.5 per cent active subscriber base and finds itself grappling with heavily falling ARPUs.
For BSNL, Aircel and Tata Teleservices (including Tata DoCoMo), the proportion of regular users is just 50-55 per cent. Tata DoCoMo, which pioneered the per second tariff war, has nearly half its mobile user base floating or belonging to the non-regular category. The ARPU for these players is much lower compared to the top three.

Shri Milind Deora, the Minister of State for Communications and Information Technology informed Rajya Sabha today in a written reply that the amounts realized by BSNL and MTNL from its customers during the year 2010-11 against the outstanding bills of previous years and bills issued during the year are Rs 12,587 crores and Rs 863 crores respectively. As on 31.3.2011, the total outstanding dues of BSNL and MTNL are Rs 5341 crores and Rs 1,103 crores respectively. Measures taken/being taken by BSNL and MTNL to recover their outstanding dues are as follows:

• Payment reminders through Interactive Voice Response System (IVRS) and Short Message Service (SMS) are being issued to persuade the customers to make payment before disconnection of their telephones.

• Graded discount scheme regarding grant of discount to defaulting customers, for clearance of old outstanding dues was introduced.

• Incentive scheme to employees of BSNL for recovery of outstanding arrears from defaulters has also been put in place.

• The progress in regard to liquidation of outstanding dues is closely monitores and units are addressed periodically.

• BSNL circles have also been asked to utilize the services of State Government Departments in recovery of outstanding dues.

• Procedure for settlement of defaulter cases through Lok Adalat has been introduced for recovery of outstanding telephone dues in respect of permanently closed connections.

Why BSNL going to loss?

Upadhyay said that the costs incurred for third generation ( 3G) and
wireless broadband access spectrum had resulted in the company's
cash reserves crashing to a mere Rs 2,500 crore by March 2011 from
around Rs 40,000 crore few years. "Spectrum charges has really
brought us badly down and made a serious dent in our cash
reserves," Upadhyay added.

Another factor that led to depletion of reserves was capital
expenditure incurred over the last few years, he said. On the PSU's
survival in the backdrop of depleting reserves and mounting losses,
he said, "We definitely do not need any bailout package from the
government. But what we do need is adequate compensation from
the government for our efforts in meeting social obligations as a
state-owned company."

Upadhyay said BSNL is operating in rural and highly remote areas
that are commercially unviable to offer telecom services.

"We want the government to compensate us for that. We are in
talks with the government and expect to receive the compensation,
which we don't consider a bailout package," he said.

The government had compensated BSNL partially for three years
from the universal service obligation fund to the tune of around Rs
2,000 crore a year but discontinued the compensation as the
scheme ended in July this year.

DoT had ordered special audit after the recommendation of telecom regulator Trai which suspected that operators were misreporting their revenues to avoid payment of licence fee to the government through revenue share.

The move was to check operators' scope to arbitrage which is shifting revenue from higher licence fee to the lower side.

The UASL (basic and mobile) telephony has a licence fee of 6-10 per cent where as NLD, ILD, ISP and Internet Protocol has six per cent.

Trai had noticed that some of operators were showing more revenue in segment that carried lower licence fee.

The special audit was for those companies which have multiple licences -- Unified Access Service Licence (UASL), National Long Distance (NLD), International Long Distance (ILD) and Internet Service Provider (ISP). All the five companies mentioned above have all these licences.

When we first looked (in June 2011), state-owned telecom giant Bharat Sanchar Nigam Ltd (BSNL) was headed for losses of Rs 2,725 crore for the year ended March 2011. In August, reports suggested unaudited losses had jumped to Rs 6,000 crore from Rs 1,823 crore in 2009-10. The final loss figure for 2010-11 stands at Rs 6,384 crore.
Worse, like state-owned Air-India, BSNL, too, appears to be in terminal decline, with sales shrinking at an alarming pace and costs — including a staggering employee bill — still rising. We take a closer look at some of BSNL’s numbers that highlight a problem symptomatic of most state-owned organisations, except of course, for an honourable few.

Sub: Interpretation of dependency criterion for grant of two family pensions under the CCS (Pension) Rules, 1972 - regarding.
The undersigned is directed to refer to this Department's O.M. No.45/86/97-P&PW(A) - Part I, dated 27th October, 1997 and O.M. No.45/51/97-P&PW(E), dated 5th March, 1998 regarding eligibility of dependent parents, sons and daughters for receipt of family pension and the income/dependency criterion prescribed for that Attention is also invited to O.M. No.38/37/08-P&PW(A), dated 2nd September, 2008 whereby the dependency criterion has been revised.
2. This Department has been receiving communications from various quarters seeking clarification whether in the wake of the Office Memoranda referred to above, second family pension is admissible to a family pensioner who is already in receipt of an amount of family pension which is equal to or more than the dependency criterion.
3. It is hereby clarified that family pension admissible to a beneficiary in respect of one deceased employee/pensioner is not to be counted as income for the purpose of determination of eligibility for another family pension, which is admissible in connection with another deceased employee/pensioner. However, any other income/earning of the beneficiary under consideration will be counted towards income for deciding eligibility for family pension.
4. It is further clarified that the sum of amount of family pensions admissible to a family pensioner as indicated above shall be regulated as per Rule 54 (11) (a) of the CCS (Pension) Rules, 1972 as amended time to time.
5. This issues with the concurrence of Department of Expenditure vide their I.D. No.383/E.V/2011, dated 22nd November, 2011.

(a)&fb): Increase in Dearness Allowance payable to Central Government employees with effect from January, 2011 will be worked out on basis of accepted formula which is based on the recommendation of 6th Central Pay Commission.
(ch(d) &(e): No proposal to declare DA as dearness pay, after DA crosses 50% is under consideration of the Government. The Sixth Pay Commission did not recommend merger of dearness allowance with Basic Pay at any stage. Government accepted this recommendation vide Government of India Resolution dated 29.8.2008.

State-owned Bharat Sanchar Nigam Ltd (BSNL), that was sitting on cash pile of over Rs 40,000 crore till March 2008, and was using its interest income to buttress its profits, may soon be forced to seek a government bailout to survive. Once considered as jewel among the India's state-run companies, BSNL is facing an uphill task of meeting its fund requirement towards capital expenditure this fiscal as its cash and bank balance reached to a critical level of Rs 2,500 crore. Off this, BSNL has a bank deposit of only Rs 840 crore while the rest is current account and being used for running its businesses.

AK Garg, director (human resources) of BSNL, has been appointed as Chairman and Managing Director of telecom PSU MTNL, company sources said today.
Garg replaces acting CMD Kuldip Singh.

Singh, the company's technical director, was given the additional charge of CMD following resignation of CMD RSP Sinha in January this year. MTNL, which provides telecom services in Delhi and Mumbai circles, had not been able to take any major decision regarding the functioning of the firm in absence of a full time CMD, said sources.
Increasing competition from private players and rising wage costs have impacted MTNL in a major way and it has been losing revenues and market share on a constant basis.
The Telecom Minister is taking a keen interest in turning around loss making PSUs like BSNL and MTNL and has recently decided to have a monthly review of their operations and performance.
The government recently appointed RK Upadhyay CMD of BSNL, which operates telecom services nationwide barring two metros -- Delhi and Mumbai.
