29.06.2010 : JAC Meeting - Joint Action Committee meeting held today and discussed about the meeting held with Hon'ble MoC&IT at Coimbatore on 25.06.2010 and decided further follow up action. Com. Convener apprised that the venue for National Convention at New Delhi on 19.07.2010 is being finalised shortly. State level conventions are decided at Hyderabad on 07.07.2010 and at Chennai on 09.07.2010. JAC wanted that circle/branch level JACs should immediately arrange dispatch of Postcards to Hon'ble Prime Minister before 05.07.2010. JAC expressed its serious concern against non-implementation of DPE OM dated 02.04.2009 regarding 78.2% IDA fitment benefit instead of 68.8% fitment. JAC got appointment with CMD BSNL to discuss the matter tomorrow morning 09:30 AM.

Five people have been arrested for inflicting a loss of crores of rupees on a public sector telecom company by making illegal international calls to friendship chat lines, the Central Bureau of Investigation (CBI) said Monday.
The accused, including an non-resident Indian (NRI) based in Saudi Arabia, were operating a racket from Roorkee in Uttarakhand by illegally activating ISD facility on local landline numbers after tampering with computers in a telephone exchange.
The racket inflicted a loss of crores of rupees on the Bharat Sanchar Nigam Limited (BSNL).
According to the CBI, the accused allegedly conspired to tamper computers of a BSNL exchange to make international calls to friendship chat lines.
'During investigation, it was revealed that the accused made calls to three African nations (Congo, Sierra Leone and Somalia) on some premium rate numbers without any ISD facility by tempering with the computers of the exchange,' a CBI official said.
Those arrested during a raid last week include Ashok Chaudhary, sub-divisional engineer of the BSNL, Roorkee, Zia Alam, a native of Faridabad in Haryana, and Abdul Mazid and Subhas Chand, both residents of Saharanpur in Uttar Pradesh.
The alleged kingpin of the racket is Sayeed Zaidi, an NRI based in Saudi Arabia, the CBI said.
'International premium rate numbers of Somalia, Cango and Sierra Leone were taken by some persons in Italy and Saudi Arabia and these numbers were passed on by them to the king-pin of this racket for making long calls from India through his Indian contacts,' the official said.
The king-pin was also paid huge money through hawala (money laundering) transactions for carrying out such activities in India, he said.
According to the CBI, searches were conducted at the premises of the accused which led to recovery of incriminating documents and huge details of money transactions.
'Till now, transactions of nearly Rs.1.5 crore by hawala has been established,' the official added.

Chennai, June 29 (PTI) A senior engineer and his son have been sentenced to one year of rigorous imprisonment each by a special CBI court here for causing wrongful loss of over Rs 1.80 lakh to the Telecom Department.

Convicts Muthumani Gunaraj, Sub-Divisional Engineer, Mambalam Telephone Exchange, Chennai and his son M G Einstein have been slapped a fine of Rs 19,000 and Rs 34,000 respectively.

A case has been registered against Gunaraj, his son Einstein and Kamaludeen alias Kamal, an employee of Einstein, alleging that during 1997-98 they entered into a criminal conspiracy to cheat the Telecom Department.

The second installment for this year (2010) of Dearness Allowance (DA) is awaited with lots of expectations…

The main expectation among lakhs of Central Government Employees will be announcement of the next additional installment of Dearness Allowance (DA) for this year….

The reasons are many…

An employee should wait for one full year to get his annual increment which is only 3% of his Basic Pay and for a promotion, the benefit is only the Grade Pay difference + 3% Increment of his Basic Pay. The Dearness Allowance (DA) is more than that because of the increases in prices of all commodities.

Dearness Allowance is an essential component of salary, it is based on monthly All India Consumer Price Index for Industrial Workers (Base year 2001-100) announced by the Labour Bureau – Government of India from time to time. After 6th CPC only the Government directed that the Dearness Allowance has to be calculated based on AICPIN with the base year 2001-100.

We have clearly stated in our site that the Dearness Allowance (DA) from Jan-2010 to Jun-2010 should be 8% with appropriate proof. Some had doubt about this, but the Government accepted and the 8% Dearness Allowance (DA) was announced (19.03.2010) from Jan-2010.

As of now, the situation demands increase in Dearness Allowance (DA) from Jul-2010 to Dec-2010 should be 44% and it will confirmed only when the All India Consumer Price Index (AICPIN) for May and June to be published. But when the index value 170 decreases to 165 or low for the next two months, the Dearness Allowance (DA) will be 8%. If it increases from 170 to 173 and above, there is a chance that the Dearness Allowance (DA) shoots up to 10%. Till now, we can conclude that additional Dearness Allowance (DA) will be 9% because there is no relief in the prices of essential commodities. But the Government will be strictly monitoring the situation and control prices that the AICPIN (All India Consumer Price Index Number for Industrial Workers (CPI-IW) on base 2001=100) value doesn’t go up.

In the next year, when DA crosses 50% all allowances will get a hike up to 25% as per the 6th CPC recommendations. This will bring some relief to the employees.

The Pensioners, State Government employees and who are all getting pay as per 5th CPC also looks forward eagerly waiting for the announcement of increase in Dearness Allowance (DA).

We have to wait for this announcement for almost two months.

On the revenues generated from the auctions, the Telecom Secretary said revenue of more than Rs 1 trillion (Rs 1,06,262.26 crores) from these auctions is unprecedented. 

''The revenue is more than 3 times the target of Rs 35,000 crores fixed by the Ministry of Finance in its budget documents and more than five times the reserve price. The realization for 40 MHz of 3G spectrum was Rs. 67,718.95 crores which is 4.75 times the reserve price of Rs. 3500 crores and Rs 1675.10 crores per MHz pan India. 

Similarly the realisation for 60 MHz of BWA spectrum was Rs. 38,543.31 crores which is 7.34 times the reserve price of Rs 1750 crores and Rs 642.39 crores per MHz pan India.

As per my information the information given on 22.6.10 by Sh. Rakesh Srivastava Ex.ADG BSNL CO, on BSNL and DOT Pensioners` Association website that the file is sent back by Secretary (T) to TPF wing for verification /occurrence, is correct. But it is not understood that when the file for revision of pension was already sent to him after proper examination by all concerned officers including Member (Services) and Member (F) of the DOT the action of Secretary attributes to delay the case further, perhaps on the behest of unabsorbed ITS officers.
 
Though during the last week Secretary (T) has given assurance to Union Leaders to complete the process within the time period fixed by Hon’ble MO(C)&IT , but the work so far done in last two months and yet to be done shows that the completion of work will take more than two months as after preparation of Cabinet Note the concerned ministries may take about two months to give their comments on revision of IDA pension against the prescribed period of fifteen days to give their comments and Cabinet may also take about one month to approve the Cabinet Note in normal process. Sh. PSR rightly said at the time of announcement by Hon’ble minister in April this year that the approval of Cabinet may be by September 10.
 
The purpose of writing is that DOT is not interested in revising the IDA pension even not willing to give correct information and concerned documents under RTI Act 2005 despite requesting twice during last six months for this under RTI Act, so we all should get together and adopt some other constitutional ways and means to get our rightful demand fulfilled.
 
I am also dealing two other cases i.e., anomaly in pension those who retired from BSNL before 31.7.2001 and revision of orders of DOT of Special Allowance to Group A on absorption in BSNL issued not as per approval of Cabinet dt. 24.7.2008 with DOT and other concerned departments under RTI Act, but unable to get any proper response from DOT, Cabinet Secretariat Rashatarpati Bhawan and DOP &PW.

In a letter to the regulator it says, "In order to favour the private operators and cause financial loss and competitive disadvantage to BSNL, the authority has used non-existent and incorrect information for giving completely impermissible and predetermined biased recommendations against BSNL."

DoT, which is still studying the recommendations, is expected to take up the issue before a full telecom commission, which will decide on the PMO request to further refer the matter to a Group of Ministers headed by the finance minister Pranab Mukherjee.

As the battleground shifts from DoT to the group of ministers, telecom operators are expected to further intensify their lobbying efforts turning up the heat on the telecom regulator.

Saddled with huge loans of Rs 7,500 crore taken for buying 3G and broadband spectrum, state- owned MTNL today said it will repay most the debt within 6 months to one year and then go for long-term debt management.

"There are various options to go for long term debt management. First of all, we are going for credit rating of the PSU shortly," Kuldeep Singh, Chairman and Managing Director, MTNL, told PTI.

The PSU had borrowed Rs 7,500 crore in the last one month to pay the government for acquiring 3G and Broadband Wireless Access (BWA) spectrum in the two metros of Delhi and Mumbai.

All finances were arranged through short-term loan and at a very competitive rate of interest ranging between 7.3 to 7.5 per cent annually, he said adding the PSU was looking for starting various new services for generating additional revenues.

Prior to this, the PSU was a debt-free company and also has cash reserves but those may be utilised for future expansion and thus the it looking at an option of partly repaying the debts and then go for long-term debts.

It had raised funds from four banks -- ICICI Bank, Yes Bank, Axis bank and Central Bank of India.

MTNL operates in Delhi and Mumbai and was given 3G and BWA spectrum about a year ago on the condition that the PSU would pay as per the final bid in the auction, that ended on May 19 for 3G and June 11 for BWA.

Delhi and Mumbai were the costliest circles as the bid for Delhi was Rs 3,316.93 crore and that for Mumbai was Rs 3,247.07 crore against the reserve price of Rs 320 crore each for both the metros in case of 3G.

Similarly for BWA, Delhi and Mumbai saw the highest bids at Rs 2,241.02 and 2,292.95 crore, respectively.

In addition to this, there will be significant pressure on profitability and the need to gain scale would induce players without 3G spectrum and new entrants to actively look at merging,”

In a strongly-worded communication to Trai, BSNL said the regulator used ‘non-existent and incorrect information for giving completely impermissible, predetermined and biased recommendations against the PSU’. It further said this was done to ‘favour private operators and cause financial losses to it as well as put it in a competitive disadvantage’.

The telco was referring to Trai’s latest recommendations, where it had said BSNL held 12.4 MHz of airwaves in most service areas and was under-utilising the same. Trai had called for the withdrawal of 2.4 MHz of airwaves from BSNL in all service areas. 


Our comments; This is a very good article. All along, unions strongly speak in dharnas and in meetings, that TRAI has come out  to destroy BSNL  and to make it sick. TRAI is favouring private operators  only and legislations and acts are to favour private operators only. Now BSNL managment  has come out openly saying that TRAI is crushing BSNL to favour private operators. Now it is our turn that all unions and management must jointedly fight for our survival.

Shri Gopal Das, is likely to step in as interim CMD?

7:40 AM -- A senior management crisis is fast developing at Indian state-owned carrier Bharat Sanchar Nigam Ltd. (BSNL) , with the top team in disarray and positions lying vacant.
The operator, which has an 11-strong management board, has been without a Finance Director since S.D. Saxena retired last year, while the director of corporate marketing, Rajendra Prasad, retired on May 31 this year and has not yet been replaced.
Most pressing of all, perhaps, is the imminent departure of Chairman and Managing Director (CMD) Kuldeep Goyal. Although he is due to retire next month, his successor has yet to be identified.
BSNL had created an internal shortlist of 20 candidates who might take on the CMD role. But following a report earlier this year from a committee headed by Sam Pitroda, adviser on public information, infrastructure, and innovation to India’s Prime Minister, that process was halted. Pitroda's report recommended the operator should appoint an external candidate. (See Is BSNL in Revamp Mode?)
BSNL's current director of Human Resources, Gopal Das, is likely to step in as interim CMD until the company decides on a full-time appointment, but such a stop-gap strategy is only likely to add to the current woes of BSNL, which faces serious financial and competitive challenges in the 20 circles (service areas) in which it operates. NEW DELHI: State run BSNL today paid Rs 8,313.8 crore for Broadband Wireless Access spectrum, two days after the deadline expired, prompting the government to slap a penalty of Rs 30 crore on the PSU.

With this, the government has got the full Rs 38,543.31 crore from the sale of BWA spectrum.

A senior Department of Telecom official said BSNL made the payment on Thursday. BSNL made the payment without any penalty.

  1. FNTO condoles the sudden and untimely demise of Shri. Jeevan Batham CS FNTO Madhya Pradesh. He was a self- made leader and has done good service to FNTO and BSNL workers. His sudden death has caused  loss to our organization which will be difficult to make good. FNTO conveys its sympathy and condolence to his bereaved family members.
  2. FNTO wholeheartedly welcome the proposal of Shri O.P. Gupta former SG NFTE, according to which all the three erstwhile federations i.e NFTE,FNTO and BTEF (BSNLMS) should fight next verification from a single platform enclosing other unions also. If this proposal of NFTE is acceptable to all then it was also suggested that this outfit can fight the elections in the name of FNTO. President FNTO agreed to place this proposal before the FNTO secretariat meeting.  It was first discussed on 4th June with Thomas John K, FNTO President by S/Shri O.P. Gupta, Islam Ahmed (President NFTE), Suresh (GS BSNL MS) and Rajpaul (AGS NFTE) at FNTO office. Next round of discussion held in NFTE office on 18-6-2010 with Shri C. Singh (GS NFTE), by K. Vallinayagam, GS FNTO in the presence of Shri O.P. Gupta who emphasized that our detailed proposal for the amendment of existing recognition rules should be submitted to management immediately and the charter of long pending workers issues also to be prepared. Secretariat meeting directed GS FNTO to further process this resolution.

Using the USO Fund subsidy, BSNL is doing the most obvious thing – cutting the monthly price; even though they aren’t charging registration, modem, security deposit and installation fees from Rural customers, the cost of a connection can easily be addressed further by making it service pre-paid and pay-per-use. But the cost of a connection is not the biggest hurdle for increasing rural broadband penetration: bigger issues are education (creating a need for broadband), and the cost of a device (PC). Concerned over revenue loss due to rise in import of unbranded Chinese mobile phones that also poses security threat, the government is considering various steps, including strict surveillance of grey market deals and restriction on import of devices without proper code.
According to one estimate, the import of unbranded Chinese mobile phones valued at Rs 4,200 crore in 2009-10. This results in huge revenue loss to the government in terms of non-payment of Value Added Tax (VAT), Octroi and entry tax.

The telecom ministry has turned down the demand by state-run operators Bharat Sanchar Nigam Ltd (BSNL) and Mahanagar Telephone Nigam Limited (MTNL) for refund of payments made towards spectrum fee for third generation (3G) telecom services. However, the two state-run telecom behemoths may be compensated but not against the 3G payments.
"There was a clear understanding between DoT (department of telecommunications), BSNL and MTNL that they would have to match the auctioning price of 3G offered to private operators.

une 19: The telecom department is working vertime to ensure that participants at the World Classical Tamil Conference in Coimbatore have glitch-free mobile connectivity at the DMK government’s showpiece event.
Work is underway to set up 130 temporary base transmission stations (BTS) at Coimbatore ahead of the conference that will begin there on June 23, Union telecom minister A. Raja said here on Saturday.

Process for 4G began

Udhagamandalam, June 19 (PTI) After conducting auctions for the 3G and BWA spectrums successfully that generated revenues of over Rs 1.06 lakh crore, the government has initiated the process to bring in next generation 4G telephony, says Telecom Minister A Raja.

Telecom regulator TRAI had released consultant papers a few weeks ago seeking views from the industry and stakeholders, he told reporters during a visit to his Lok Sabha constituency in the Nilgiris.

The 4G process would be expedited after the receipt of the required feedback and TRAI's recommendations, Raja added.

Fourth-generation telecom technology (4G), also known as ultra-broadband, offers faster download speed and on-demand high definition video -- among other services.

Raja said BSNL has erected 130 BTS towers and 20 mobile vans at the venue of the World Classical Tamil Conference, which would begin on June 23 in Coimbatore, to provide uninterrupted communication facilities.

JAC Meeting on 17/6/2010
JAC meeting held today at New Delhi under the chairmanship of Shri.G.L.Jogi GS SNEA. As there was proper communication to this effect FNTO / BWA participated in the meeting.
After clarification by convener on the communication gap regarding last meeting Chairman assured that more care will be taken in such sensitive matters of communication and consultation in future. After detailed deliberations the following decisions were taken in the meeting.
1)       To meet secretary DOT, HMOC, HFM and HTM to appraise the situation arising out of paying spectrum charges/BWA charges etc by BSNL to govt. and also settlement of pending issues, including purchase of GSM equipment.
2)       To meet CMD on 19/6 to urge him to defer payment of BWA charges and also ask for waival of spectrum charges paid
3)       To launch an awareness campaign among the workers on the above issues to prepare them for prolonged struggle
Meeting with GM Establishment and PGM Finance BSNL CO.

We also stated that in circles like A.P, Karnataka etc transfers are being ordered even after the academic year is over against the transfer policy. We requested him to avoid transfer for transfer sake in the circles mentioned above.
The above leaders also met CGK Pillai (PGM – F) and discussed regarding relaxation in qualifying marks for JAO Part II candidates, citing various precedents.

However, due to these differences, the whole process has been delayed and the government might have to give additional charge of the BSNL CMD to a Director, the official added.
According to BSNL officials, this might create more problems, with the company already facing a tough time with the arrival of new telecom competitors. BSNL once had a market share of 20 per cent and this is now 12 per cent. It was also giving tough competition to market leader Bharti Airtel till two-three years before, but now has slipped to fifth position.
The procedural delays related to purchase of equipment and dependence on the government for decision making approvals are hampering the company’s growth. BSNL’s 93-million-line GSM tender was cancelled due to various controversies and differences . The company is facing a huge capacity crunch in many places. The Pitroda committee had also suggested BSNL go for outsourcing of network management, a system followed by other competing private telecom companies such as Bharti Airtel. DoT is yet to act on the Pitroda recommendations.

Despite their sharp 9.9% climb in Wednesday’s session, shares in state-run Indian telecom firm Mahanagar Telephone Nigam Ltd., or MTNL, look far from being tired, judging by their over 7% rise Thursday to 65.60 rupees — the highest level in over a month.
Until Wednesday media reports claiming that Bharat Sanchar Nigam Ltd. — another state-run telecom firm — had asked the government to refund the amount it paid for 3G spectrum and intended to seek a waiver for the amount that it must pay for new broadband wireless internet radio bandwidth it received recently, led to speculation that MTNL might do the same and may have fueled the rise.

           Sub:- Request for expeditious settlement of revised wages and         
                                  pensionary benefits thereof -- reg.
          
            I hasten to bring to your kind notice that even after the drawal of arrears on account of 2nd wage revision to the serving employees of BSNL, the pay fixation for the employees retired from 1.1.2007 to 30.4.2010 has not been done and arrears drawn so far. In some SSAs, the pay fixation has been done partially and yet to be completed.
Generally it is told that in the absence of instructions/directions from Pune for HRMS package, the claims of the retired employees could not be done. It is most unfortunate to deny the claims of the Senior Citizens citing the above reasons. The following are the items of work relating to the BSNL employees retired from 1.1.2007 to 30.4.2010 to be attended to immediately without further delay.

(1) Fixation of revised pay from 1/1/2007 in the revised pay scales
(2) Drawal of arrears on the above revision.
(3) Revision of Pensionary benefits based on the revised pay fixation from 1.1.2007

       In this connection it may be mentioned that the proposals for Revision of pension consequent on the merger of 50% IDA with pay from 1.1.2007 already sent to DOT cell by various SSAs have not been processed due to the impending wage revision except in some cases. Thus the claims of the retired employees are not given due consideration for an early settlement.

     This union therefore request the CGM to kindly look into the matter urgently to cause issue of appropriate instructions or guidelines to all Heads of SSAs for settlement of the dues of the post-2007 retired employees without any further delay.

03.06.2010: All News Papers and Electronic Media has covered about the SCAM of Rs 1.4.Crores. The actual details are.
  1. During 2007 / 2008 BSNL instead of Printing the RCs , issues E Pins through CDs to the Franchisees. Each CD has 5000 EPins worth of Rs 112/ each..
  2. SDE on transfer from Khammam Sri Lokanatha Rao has taken over the Charge as SDE Sales during July 2009. 
  3. Whenever he is going on leave the charge was made over to Sri Nageswar Rao another SDE working under DE Sales.
  4. During march 2010 there was misappropriation of RCs worth Rs 1.30 Lakhs and Administration insisted Mr Lokanatha Rao to pay the amount so the no action will be initiated.
  5. Sri Lokanatha Rao fearing punishment paid the amount withdrawing from GPF.
  6. Administration transferred Lokanatha Rao to Mushirabad and instructed to Make over the charge to Nageswar Rao.
  7. During M/o, observed 26 CDs which were  supposed to contain the 5000 E Pins of Rs112[ ( 112 X 5000 =  Rs5,60,000) worth per CD equal to Rs1.45 Crores] were found without any data.
  8. Administration verified and found that majority were activated during November 2009 and March 2010.
  9. Presently case is booked in the Saifabad Police Station and are investigating.
  10. Both the SDEs are under suspension.
  11. The rumors are floating in Hydearabad that some top level Officers of BSNL are also involved in this scandal. Police assured to catch the culprits very shortly.
Inspite of Association requesting CGMT during Feb /  March 2010, when one of the Franchisee cheated BSNL by circulating in the market the fake RCs, the Administration failed to take any action and this inaction of the administration is leading to one scam after another. 
Association is in continuous touch with GM Sales and DGM Sales and assured to help in all respects to catch hold of the culprit in what ever position he may be occupying in BSNL.

Mittal expressed his frustration over Trai recommendations, which linked 2G spectrum prices to 3G, entailing very heavy payouts by telecom operators: “There is a proposal to charge more from those who are established and bigger players. Now, I can’t run with too much weight around my neck. I am a better horse in running in the market place and I can take an extra weight around my neck, but I cannot take a rock and run in the marketplace. And that’s precisely what the regulations are trying to do. The regulations are being geared towards hurting the large players that they must pay more, but people who have got licences yesterday must pay nothing. I am happy if the country decides to have a punitive regime for telecom, but then let it be punitive for all,” he said.

  • No prior intimation was given to majority of the unions regarding the meeting.
  • No prior consultation with other unions on mode of agitation or dates.
  • Notice was served on management regarding agitation arbitrarily.
  • Decision by a few unions should not be imposed on majority unions in the name of JAC
  • FNTO request for reconvening the meeting to discuss and take a popular decision on agitation has been ignored.
  • Hence FNTO / BWA regret to participate in the above agitation.
