Status of the ITS repatriation case in the Hon’ble Delhi High Court
ITS issue in the court.
The ITS repatriation case came up for hearing in the
Hon’ble Delhi High Court today the 31.10.2012. Senior
Council Shri Patwalia, who appeared on behalf of the
BSNLEU, SNEA and AIBSNLEA, submitted to the judges that
the unabsorbed ITS officers should be repatriated to DoT,
immediately, since their continuation in BSNL on
deputation is illegal and that there are sufficient staff
and officers to run BSNL. However, the Assistant Solicitor
General did not turn up and on his behalf the court was
requested to adjourn the hearing. Thereafter, the Hon’ble
judges adjourned the hearing to 07.11.2012, and directed
that the reply affidavit should be filed.

Shri Kapil Sibal, Hon’ble Minister of Communications,
today the 30.10.2012, on the ITS issue. Com. V.A.N.
Namboodiri, Convener, Com. P. Abhimanyu, BSNLEU, Com. C.
Singh, NFTE, Com. G.L. Jogi & Com. K. Sebastin (SNEA),
Com. Prahlad Rai (AIBSNLEA), Com. Suresh Kumar (BSNL MS),
Com. N.D. Ram (SEWA BSNL), Com. Amit Roy (AIGETOA), Com.
Zile Singh (NTSU) and Com. M.K. Bagchi, Com. Kaushik, Com.
Mange Ram (MTNL). The Leaders told Shri Kapil Sibal, that
either the ITS Officers should get absorbed in BSNL & MTNL
or they should be repatriated. They should not be allowed
to continue on deputation in BSNL & MTNL. The leaders also
requested the Hon’ble Minister to ensure the immediate
refund of money, on account of refund of BWA spectrum by
BSNL and also the immediate payment of Rs.1500/- crore
compensation to BSNL, as recommended by TRAI. The Hon’ble
Minister patiently heard the leaders and assured that the
needful would be done.

United Forum serves strike notice demanding immediate arrest of Adesh Kumar Gupta and other culprits
The United Forum served notice on the CMD, BSNL, for one
day strike, to be held on 16.11.2012, demanding the
immediate arrest and suspension of Adesh Kumar Gupta, GM,
BSNL and four other culprits. FNTOBEA will issue a
separate strike notice from Chennai, since Com. P.
Andiappan, GS, FNTOBEA, could not come over to Delhi to
sign the strike notice.

Implement the agitational programme of the Forum of BSNL Unions/Associations in the most successful manner.
The Forum of BSNL Unions and Associations has given call
to conduct the following agitational programme on the very
important issue of immediate repatriation of the
non-absorbed ITS officers, as per the directive of the
Hon’ble High Court, Delhi. This is a period of so many
agitations. Already calls are given by the United Forum as
well as the BSNLEU to conduct some other agitational
programme, on certain other vital issues. CHQ is aware of
the difficulties of our comrades at the Circle and
District levels in implementing so many agitations at a
stretch. However, it is also very important to implement
the decisions of the Forum of BSNL Unions and
Associations. Hence, CHQ calls upon the Circle and
District Unions to powerfully conduct the following
programme on ITS repatriation issue.
(1)
Day long hunger strike from 10:00 AM to 6:00 PM at
SSA/Circle
/Corporate Office levels for one week from 29.10.2012.
(2)
March to Raj Bhawan/Collectorate on 30.10.2012. (As
far as the March
to Parliament is concerned, the Forum has decided to hold
it on 22.11.2012,
when
the Winter Session of the Parliament begins.)

BSNL death: Family wants CBI probe
GHAZIABAD: The family of the BSNL union leader Sukhvinder Pal,
who died under mysterious circumstances at the Raj Nagar District
Centre on October 22, has demanded a CBI probe into the matter. Family
members and other union leaders from across the country staged a protest
in Ghaziabad on Thursday and shot off a letter to UP chief minister
Akhilesh Yadav, the PMO and the NHRC demanding a CBI probe into the
matter and transfer of the case to Delhi.
"We have no faith in Uttar Pradesh Police. We have not received any satisfactory response from them. My father's murder was the result of a strong nexus of the top brass and contractors of BSNL," alleged the victim's son, Rohan. "We have lost hope of getting justice in Uttar Pradesh, so we have written letters to the PMO, NHRC and Uttar Pradesh CM demanding transfer of the case to Delhi and a full-fledged investigation by the CBI," he added.
The police have preserved the viscera of the deceased. Cops have even questioned other BSNL employees and colleagues of the deceased to establish the case. The station officer of Kavi Nagar police station, Sudhir Tyagi, said there were two injury marks on the deceased's body — one on the head and the second below his eyes. "The exact cause of death could not be established so we have preserved the viscera which will be sent for further examination," Tyagi said.
BSNL union leaders also gave the police a memorandum citing that the deceased's death was result of exposing scams and nexus between officials and contractors in the department. "Pal had exposed various scams in the department. Fearing legal action after exposure of the scams, department officials and other people involved in the scams eliminated him," said Ashok Singh, a BSNL union member.

Lucknow: An employee with the Bharat Sanchar Nigam Limited (BSNL) was on Monday beaten to death inside a telephone exchange in Ghaziabad, police said.
According to information available, the victim got into an altercation with the General Manager (GM), who called in security guards, who in turn beat him to death.
Senior Superintendent of Police (SSP) Ghaziabad Prashant Kumar told IANS that the 46-year-old victim, named Sukhendra Singh, worked at the Rajnagar exchange. He was also the secretary of the workers' union and had been called on Monday morning by the GM for some work-related discussion, which apparently went awry and resulted in Singh's death.
Police said that a case has been registered against the GM and five BSNL employees

Asking to pay spectrum amount is unfair

It would be wrong on the Government’s part to impose a one-time fee on incumbent mobile telecom operators for their ‘excess’ subscriber-linked spectrum, whether it is linked to the price discovered in the upcoming 2G auctions or otherwise. The ostensible logic behind the move — already cleared by an Empowered Group of Ministers — is to create a level-playing field between the incumbents already having spectrum and the new players who would be paying more through the auction route. Moreover, the proposed impost, it is argued, is only on the additional spectrum being held by the incumbents, over and above the original 4.4 MHz bundled with their operating licence. Lastly, the fact that the auction price-linked levy will be applicable only for the remaining part of their 20-year licence period makes it seem all the more equitable.

Meeting of all unions conducted by BSNL Management
The all unions meeting, called on by the Management, took place today the 16.10.2012.
The meeting was presided over by Shri N.K. Narang, PGM (SR), BSNL.
Unions spelt out their views. The views were varied and mixed.
After hearing the views, management assured to call another meeting on the subject soon.

make payment of minimum PLI, (Productivity Linked
Incentive) as per the existing formula before Pooja.
Evolve a new PLI formula, as per the decision taken in
the 27th National Council meeting.
ii) Exempt
BSNL from the payment of one time spectrum fee, as
decided by the Empowered Group of Ministers, for the
2G spectrum being held by BSNL, over and above 4.4
MHz.
iii) Rescind
the Cabinet decisions to introduce 26% FDI in Pension
Fund and to increase the quantum of FDI from 26% to
49% in the insurance sector.
Circle and District Secretaries are requested to
coordinate with other constituents of the United Forum
and conduct the programme massively.

Forum of BSNL Unions and Associations meeting at CHQ, New Delhi:
Forum of BSNL Unions and Associations leaders met today to discuss & review the status of pending issues and the burning issue of ITS absorption in BSNL. Com. V.A.N. Namboodiri, Convener apprised in detail the status of pending issues and burning issue of ITS absorption. Com. Prahlad Rai, GS AIBSNLEA presided over the meeting. After detailed discussions and analyzing the ongoing situation in BSNL on ITS absorption issue, the Forum representatives expressed their serious resentment against the efforts of DoT Administration & BSNL Management allowing continuous ITS deputation in BSNL violating Govt. orders and decided to strongly oppose this legally and organisationally. The following organisational action programmes are unanimously decided :
Demand
End deputation and relieve all the
non-optee ITS or
Revert back all the BSNL employees
(Absorbed & BSNL recruited) to DoT as Govt. servants like ITS.

11-10-2012: Lunch/Closing hour demonstration at
BSNL CO, Circle/SSA HQs & Savingram campaign to Hon'ble Prime Minister,
Cabinet Secretary, Hon'ble MOC& IT, Secretary(T), DoT and CMD, BSNL
15-10-2012: One Day MASS DHARANA
at BSNL CO, Circle/SSA HQs.
26-10-2012: Parliament March at
New Delhi, Raj Bhavan March at State Capitals and Collectorate March at
District HQs.
29-10-2012 to 03-11-2012: Day
long Hunger strike for 6 days (10.00 Hrs. to 18.00 Hrs.) at BSNL CO, Circle/SSA

Non Cooperation movement will start w.e.f. 25-10-2012 morning itself.
In case the
deputationist ITS are not relieved from BSNL by that time, the Forum has
decided to go on indefinite strike immediately. The agitation programmes
will continue till the time deputationist ITS' are relieved from BSNL. MTNL
Unions/Associations will also be contacted shortly to organize joint
struggles..
Forum
representatives expressed their serious anguish against BSNL Management's
comment that on relieving of 1000 ITS, BSNL will collapse/locked out
denouncing the very existence of 2.7 lakhs BSNL employees. Hence, Forum
decided that now CMD BSNL has to decide that whether he will run BSNL with
the presence of 1000 deputationist ITS or 2.7 lakhs BSNL employees. More
details will be given shortly.
