In a significant judgment, the Chandigarh Consumer Disputes Redressal Commission has said cases against telecom service providers can be adjudicated in consumer courts and it is not essential for the complainant to go through the lengthy arbitration process.
The decision was passed by Commission president Jagroop Singh Mahal in a case against Vodafone. The counsel for the company had claimed that disputes with respect to “telegraph line” were not in the jurisdiction of the consumer fora, and could be decided only through arbitration. The Vodafone counsel also referred to a decision of the Consumer Disputes Redressal Commission, Chandigarh, in a case titled “Reliance Communication vs Harminder Singh”.
In the case, the Commission had ruled that the mobile phone was covered under Section 7-B of the Indian Telegraph Act and as such the consumer forum had no jurisdiction to try the case. The commission, however, did not find any merit in the argument and passed the judgement against the telecom operator.
