Another Landmark Judgment from Madras CAT - Condemnable act of BSNL-(Mis) Management
The Hon'ble Madras Bench of CAT has come heavily on the malice acts of BSNL management in SURINDER KUMAR vs BSNL & others.
After getting favourable judgment from EPFO in respect of Para 32 violation of EPF Scheme, Shri Surinder Kumar JAO (AGS AIGETOA) was transferred vindictively and arbitrarily from STR Chennai to Cuddalore (Tamil Nadu Circle) without TA/DA and joining time.
The writ petition was filed, challenging his 5th transfer in the short period of 2.5 years to Cuddalore; and Hon'ble Madras High Court was pleased to stay the transfer at the time of admittance of writ itself. While adjudicating the matter, the Hon'ble Madras CAT categorically concluded that this transfer was effected by BSNL management on Malice, Arbitrariness and Unfound facts. The Hon'ble CAT also adjudicated that the transfer was effected in violation of BSNL's Transfer Policy.
As members are aware that Shri Surinder Kumar has been exposing the wrongdoers in BSNL since his appointment, was in the hit-list of these honchos. While working at Madurai, he exposed the corruption of Rs 26 lakhs, where STR Chennai purchased DWDM transmission accessories at exorbitant price of Rs 61 lakhs as against the fair price of Rs 35 lakhs. Similarly, while working at Chennai he exposed the corruption of several crores of Rupees, where part of V-SAT equipments were purchased from SSI's. But, BSNL-(Mis)Management each time rewarded him with transfers.
Even at one point in time, BSNL-(Mis) Management pigheadedly went on declaring him surplus so that he could be taken into task. BSNL shamelessly defended each of its malicious and arbitrary act.
